The Notice proposed\nfinding that Respondent had violated the pipeline safety regulations in 49 C.F.R. Part 195. The\nNotice also proposed certain measures to correct the violations. Maverick Natural Resources,\nLLC, on behalf of Breitburn Operating L.P., did not contest the allegations of violation or\ncorrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Breitburn Operating\nL.P., violated the pipeline safety regulations listed below, as more fully described in the enclosed\nNotice, which is incorporated by reference:\n49 C.F.R. § 195.402(c)(13) (Item 2) ─ Respondent failed to conduct periodic\nreviews of the work done by operator personnel to determine the effectiveness of\nthe procedures used in normal operation and maintenance, and take corrective\naction where deficiencies were found.\n49 C.F.R. § 195.403(a) (Item 3) ─ Respondent failed to provide records\nindicating it conducted periodic emergency response training.\n49 C.F.R. § 195.440(c) (Item 4) ─ Respondent failed to follow the general\nprogram recommendations, including baseline and supplemental requirements of\nAPI RP 1161.\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Breitburn Operating L.P.\n\n\n\nCompliance Actions\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Breitburn Operating L.P., is ordered\nto take the actions proposed in the enclosed Notice to correct the violations. The Director may\ngrant an extension of time to comply with any of the required items upon a written request timely\nsubmitted by Respondent and demonstrating good cause for an extension. Upon completion of\nthe ordered actions, Breitburn Operating L.P., may request that the Director close the case.\nFailure to comply with this Order may result in the assessment of civil penalties under 49 C.F.R.\n§ 190.223 or in referral to the Attorney General for appropriate relief in a district court of the\nUnited States.\nWarning Item\nWith respect to Item 1, the Notice alleged probable violations of 49 C.F.R. § 195.49 but did not\npropose a civil penalty or compliance order for this Item. Therefore, this is considered to be a\nwarning item.
