S. C. $ 60117, a representative of the Pipeline and\nHazardous Materials Safety Administration's (PHMSA's)' Office of Pipeline Safety conducted\nan on-site pipeline safety inspection of Respondent's facilities from the United States — Canadian\nborder to Raynesford, Idaho, as well as records in Respondent's Sand Point, Idaho, and Portland,\nOregon, offices. As a result of the inspection, the Director, Western Region, PHMSA, issued to\nRespondent, by letter dated May 29, 2003, a Notice of Probable Violation and Proposed\nCompliance Order (Notice). In accordance with 49 C. F. R. $ 190. 207, the Notice proposed\nfinding that Respondent violated 49 C. F. R. ) 192. 739 (a-d) and proposed ordering Respondent to\ntake certain measures to correct the alleged violations. The Notice also contained a warning that\nRespondent had committed a probable violation of 49 C. F. R. $192. 459 and advised Respondent\nto take appropriate corrective action.\nRespondent responded to the Notice in letters dated June 26, 2003, October 3, 2003, January 6,\n2004, June 11, 2004, November 15, 2004, and April 12, 2005 (collectively, Response).\nRespondent did not contest the allegations of violation but provided information concerning the\ncorrective actions it had taken. Respondent did not request a hearing, and therefore has waived\nits right to one.\n' Effective February 20, 2005, the Pipeline and Hazardous Materials Safety Administration (PHMSA) succeeded\nResearch and Special Programs Administration as the agency responsible for regulating safety in pipeline\ntransportation and hazardous materials transportation See, section 108 of the Norman Y. Mineta Research and\nSpecial Programs Improvement Act (Public Law 108-426, 118 Stat. 2423-2429 (November 30, 2004)). See also, 70\nFed. Reg 8299 (February 18, 2005) redelegating the pipelme safety authorities and functions to the PHMSA\nAdministrator.\nThe Notice of Probable Violation and Proposed Compliance Order was issued to PG&E National Energy Group\nIn 2004, TransCanada Corporation acquired Gas Transmission Northwest Corporation, which does business as the\nTransCanada GTN System\n\n\n\nFINDING OF VIOLATION\nBased upon the Notice and information submitted by Respondent, I find that Respondent\nviolated of 49 C. F. R. $ 192. 739 (a-d), as follows:\nNotice Item 2 - By failing to complete inspection and testing of pressure regulators or\npressure relief valves associated with the fuel gas systems for each compressor station\nonce each calendar year not to exceed 15 months and failing to maintain overpressure\nprotection to ensure that the segment in the United States met U, S. requirements.\nThis finding of violation will be considered a prior offense in any subsequent enforcement action\ntaken against Respondent.\nCOMPLIANCE ORDER\nThe Notice proposed a Compliance Order with respect to Items 2a and 2b in the Notice. Under\n49 U. S. C. $ 6011S(a), each person who engages in the transportation of gas or who owns or\noperates a pipeline facility is required to comply with the applicable safety standards established\nunder Chapter 601. The Director, Western Region, PHMSA, indicates that Respondent has\namended its program/procedures and addressed the matters concerning inspections and records\nspecified in the proposed compliance order.\nAccordingly, since compliance has been achieved with respect to these violations, the\ncompliance terms are not included in this Order.\nWARNING ITEM\nWith respect to Item 1, the Notice alleged a probable violation of Part 192 but did not propose a\ncivil penalty or compliance order for this item. Therefore, this is considered to be a warning\nitem. Pursuant to 49 C. F. R. $ 190. 205, Respondent is warned that if PHMSA finds a violation\nfor this item in a subsequent inspection, enforcement action will be taken.\nThe terms and conditions of this Final Order are effective on receipt.\neffr\ncti\ny .
