Dakota Ave, Suite 110\nLakewood, CO 80228\nNOTICE OF AMKNDMKNT\nCERTIFIED MAIL - RETURN RECEIPT RE UESTED ~ENT To COMPLTANCE REG1STRy\nHardcopy Electromcally u-\nMarch 5, 2007\n¹ of Copies i /Date~ 7\nMr, Wayne Campbell\nCity of Victorville\n14343 Civic Drive\nVictorville, CA 92392-2399\nCPF 5-2007-0007M\nDear Mr. Campbell:\nOn September 18, 2006, a representative of the Pipeline and Hazardous Materials Safety\nAdministration (PHMSA) pursuant to Chapter 601 of 49 United States Code inspected The City\nof Victorville's procedures for Operations and Maintenance Procedural Manuals in Victorville,\nCalifornia.\nOn the basis of the inspection, PHMSA has identified the apparent inadequacies found within The\nCity of Victorville's plans or procedures, as described below:\n$191. 5 Telephonic notice of certain incidents.\n(a) At the earliest practicable moment following discovery, each operator shall give\nnotice in accordance with paragraph (b) of this section of each incident as defined in\n$191. 3.\n(b) Each notice required by paragraph (a) of this section shall be made by telephone\nto 800-424-8802(in %ashington, DC, 267-2675) and shall include the following\ninformation:\n(1) Names of operator and person making report and their telephone numbers.\n(2) The location of the incident.\n(3) The time of the incident.\n(4) The number of fatalities and personal injuries, if any.\n(5) All other significant facts that are known by the operator that are relevant to the\ncause of the incident or extent of the damages.\n\n\n\nThe City of Victorville's Operation and Maintenance (O&M) manual for its natural gas\ndistribution system did not have adequate incident reporting requirements. Specifically, it did not\nhave procedures for \"Telephonic Notices of Certain Incidents. \"\n2. f191. 9 Distribution system: Incident report.\n(a) Except as provided in paragraph (c) of this section, each operator of a\ndistribution pipeline system shall submit Department of Transportation Form\nRSPA F 7100. 1 as soon a practicable but not more than 30 days after detection of an\nincident required to be reported under f191. 5.\n(b) %'hen additional relevant information is obtained after the report is submitted\nunder paragraph (a) of this section, the operator shall make supplementary reports\nas deemed necessary with a clear reference by date and subject to the original report.\nThe City of Victorville's O&M manual did not have procedures for submitting written \"Incident\nReports. \"\n3. f192. 513 Test requirements for plastic pipelines.\n(a) Each segment of a plastic pipeline must be tested in accordance with this section.\n(b) The test procedure must insure discovery of all potentially hazardous leaks in\nthe segment being tested.\n(c) The test pressure must be at least 150 percent of the maximum operating\npressure or 50 p. s. i. (345 kPa) gage, whichever is greater. However, the maximum\ntest pressure may not be more than three times the pressure determined under\nf192. 121, at a temperature not less than the pipe temperature during the test.\nThe City of Victorville's O&M manuals specifies the test pressure to be no less than 30 psi for 10\nminutes. The test pressure for plastic pipelines needs to be 150% of MAOP or 50 psi, whichever\nis greater.\nRes onse to this Notice\nThis Notice is provided pursuant to 49 U. S. C. $ 60108(a) and 49 C. F. R. $ 190. 237. Enclosed as\npart of this Notice is a document entitled Response Options for Pipeline Operators in Compliance\nProceedings. Please refer to this document and note the response options. Be advised that all\nmaterial you submit in response to this enforcement action is subject to being made publicly\navailable. If you believe that any portion of your responsive material qualifies for confidential\ntreatment under 5 U. S. C. 552(b), along with the complete original document you must provide a\nsecond copy of the document with the portions you believe qualify for confidential treatment\nredacted and an explanation of why you believe the redacted information qualifies for\nconfidential treatment under 5 U. S. C. 552(b). If you do not respond within 30 days of receipt of\nthis Notice, this constitutes a waiver of your right to contest the allegations in this Notice and\nauthorizes the Associate Administrator for Pipeline Safety to find facts as alleged in this Notice\nwithout further notice to you and to issue a Final Order.\n\n\n\nIf, after opportunity for a hearing, your plans or procedures are found inadequate as alleged in this\nNotice, you may be ordered to amend your plans or procedures to correct the inadequacies (49\nC. F. R. ) 190. 237). If you are not contesting this Notice, we propose that you submit your\namended procedures to my office within 30 days of receipt of this Notice.
