Department\nof Transportation\nPipeline and\nHazardous Materials Safety\nAdministration\n12300 W Dakota Ave, Suite 110\nLakewood, CO 80228\nNOTICE OF AMENDMENT\nCERTIFIED MAIL - RETURN RECEIPT RE UESTED\nApril 20, 2007\nMr. Ross Parker\nRegional Director\nGTN and North Baja Systems\n1400 SW 5 Ave.\nSuite 900\n,\nPortland, WA 97201\nSENT TO COMPLIANCE REGISTRY\nHardcopy Electromc y\n¹ofCoptea i /Date /&7\nCPF No. 5-2007-0016M\nDear Mr. Parker:\nBetween November 13 and December 1, 2006, a representative of the Washington Utilities\nand Transportation Commission (WUTC) acting as an agent, for the Pipeline and Hazardous\nMaterials Safety Administration (PHMSA), pursuant to Section 60106(a) of Title 49, United\nStates Code, conducted an onsite pipeline safety inspection of your pipeline facilities in\nWashington State.\nOn the basis of the inspection, PHMSA identified the apparent inadequacies found within\nGTN's plans or procedures, as described below:\n$192. 715 Transmission lines: Permanent field repair of welds.\nEach weld that is unacceptable under $1 92. 241(c) must be repaired as follows:\n(a) If it is feasible to take the segment of transmission line out of service, the weld\nmust be repaired in accordance with the applicable requirements of $192. 245.\n(b) A weld may be repaired in accordance with $1 92. 245 while the segment of\ntransmission line is in service if:\n(1) The weldis not leaking:\n(2) The pressure in the segmentis reduced so that it does not produce a stress that is\nmore than 20 percent of the SMYS of the pipe; and\n(3) Grinding of the defective area can be limited so that at least 1/8-inch (3. 2\nmillimeters) thickness in the pipe weld remains.\n\n\n\n(c) A defective weld which cannot be repairedin accordance with paragraph (a) or\n(b) of this section must be repaired by installing a full encirclement welded\nsplit sleeve of appropriate design.\nGTN did not have procedures in their O&M manual that would allow them to\nimplement a three part weld repair procedure. This would require repair of welds by\nreducing pressure first, using bolt on clamps or taking the pipeline out of service.\n$192. 71 7 Transmission lines: Permanent field repair of leaks.\nEach permanent field repair of a leak on a transmission line must be made by-\n(a) Removing the leak by cutting out and replacing a cylindrical piece of pipe; or\n(b) Repairing the leak by one of the following methods:\n(1) Install a full encirclement welded split sleeve of appropriate design,\nunless the transmission line isjoined by mechanical couplings and operates\nat less than 40 percent of SMYS.\n(2) If the leak is due to a corrosion pit, install a properly designed bolt-on-\nleak clamp.\n(3) If the leak is due to a corrosion pit and on pipe of not more than 40, 000\npsi (267 Mpa) SMYS, fillet weld over the pitted area a steel plate patch with\nrounded corners, of the same or greater thickness than the pipe, and not more\nthan one-half of the diameter of the pipe in size.\n(4) If the leak is on a submerged offshore pipeline or submerged pipeline in\ninland navigable waters, mechanically apply a full encirclement split sleeve of\nappropriate design.\n(5) Apply a method that reliable engineering tests and analyses show can\npermanently restore the serviceability of the pipe.\nGTN did not have procedures in their O&M manual that would allow them to follow\nregulatory criteria when repairing field leaks. This criterion is outlined in 192. 717(a)\nthrough (b) (5).\nRes onse to this Notice\nThis Notice is provided pursuant to 49 U. S. C. $ 60108(a) and 49 C. F. R. $ 190. 237. Enclosed\nas part of this Notice is a document entitled Response Options for Pipeline Operators in\nCompliance Proceedings. Please refer to this document and note the response options. Be\nadvised that all material you submit in response to this enforcement action is subject to being\nmade publicly available. If you believe that any portion of your responsive material qualifies\nfor confidential treatment under 5 U, S, C. 552(b), along with the complete original document\nyou must provide a second copy of the document with the portions you believe qualify for\nconfidential treatment redacted and an explanation of why you believe the redacted\ninformation qualifies for confidential treatment under 5 U. S. C. 552(b). If you do not respond\nwithin 30 days of receipt of this Notice, this constitutes a waiver of your right to contest the\nallegations in this Notice and authorizes the Associate Administrator for Pipeline Safety to\nfind facts as alleged in this Notice without further notice to you and to issue a Final Order.\n\n\n\nIf, after opportunity for a hearing, your plans or procedures are found inadequate as alleged in\nthis Notice, you may be ordered to amend your plans or procedures to correct the inadequacies\n(49 C. F. R. $ 190. 237). If you are not contesting this Notice, we propose that you submit your\namended procedures to my office within [number of days] days of receipt of this Notice. This\nperiod may be extended by written request for good cause.
