Ocean Boulevard Long Beach, CA 90802 CPF 5-2QQ7-20Q1M Dear Mr. Dudics: On June 12„2006, a representative of the Pipehne and Hazardous Materials Safety Administration (PHMSA) and a representative of the California State Fire Marshall office (SFM), pursuant to Chapter 601 of 49 United States Code, conducted an inspection of the Thums Long Beach Company (Thums) Operator Quahfication (OQ) program for your pipeline personnel in Long Beach, Cahfornia. On the basis of the inspection, PHMSA identified apparent inadequacies found within Thums OQ plan as described below: 1. g 192. 805 Qualification Program a) Identify covered tasks; Thums Operator Quahfication Plan provided a hsting of covered tasks, but several tasks were not described or documented. Tasks no. 15, 16, 19, 20, and 29 were not described or documented. Thums Operator Qualification Plan described provisions to allow individuals that are not quahfied to perform covered tasks if directed and observed by an individual that is qualified, but there were no hmitations or restrictions placed on these acitivities. C. $ 60108(a) and 49 C. F. R. $ 190. 237. Be advised that all material you submit m response to this enforcement action is subject to being made pubhcly available. F. R. $ 190. 237). If you are not contesting this Notice, we propose that you submit your amended procedures to my office within thirty days of receipt of this Notice. This period may be extended by written request for good cause. Once the inadequacies identified herein have been addressed in your amended procedures, this enforcement action will be closed.
