Depariment\nof Transportation\nPipeline and\nHazardous Naterlals Safety\nAdministration\nNOTICE OF AMENDMENT\nCERTIFIED MAIL - RETURN RECEIPT RK UESTED\nJanuary 9, 2008\nRoss Parker\nRegional Director\nTransCanada — Gas Transmission Northwest\n1400 SW 5th Avenue\nSuite 900\nPortland, OR 97201\nCPF 5-200S-1003M\nDear Mr. Parker:\nOn June 25 to 29, 2007, a representative of the Pipeline and Hazardous Materials Safety\nAdministration (PHMSA), pursuant to Chapter 601 of 49 United States Code, inspected\nTransCanada procedures for operations and maintenance in Spokane, Washington,\nOn the basis of the inspection, PHMSA has identified the apparent inadequacies found within\nTransCanada plans or procedures, as described below:\n$192. 605 Procedural manual for operations, maintenance, and emergencies\nEach operator shall include the following in its operating and maintenance plan:\n(b) Maintenance and normal operations. The manual required by paragraph (a)\nof this section must include procedures for the following, if applicable, to provide\nsafety during maintenance and operations.\n(1) Operating, maintaining, and repairing the pipeline in accordance with each of\nthe requirements of this subpart and Subpart M of this part.\nAnd\n\n\n\n$192. 713 Transmission lines: Permanent field repair of imperfections and\ndamages.\n(a) Each imperfection or damage that impairs the serviceability of pipe in a steel\ntransmission line operating at or above 40 percent of SMYS must be-\n(1) Removed by cutting out and replacing a cylindrical piece of pipe; or\n(2) Repaired by a method that reliable engineering tests and analyses show can\npermanently restore the serviceability of the pipe.\n(b) Operating pressure must be at a safe level during repair operations.\nThe following procedure was found to be inadequate for qualifying welders.\n$192. 227 Qualification of welders.\n(a) Except as provided in paragraph (b) of this section, each welder must be\nqualified in accordance with section 6 of API 1104 (incorporated by reference, see g\n192. 7) or section IX of the ASME Boiler and Pressure Vessel Code (incorporated by\nreference, see g 192. 7). However, a welder qualified under an earlier edition than\nlisted in g 192. 7 of this part may weld but may not requalify under that earlier\nedition.\n(b) A welder may qualify to perform welding on pipe to be operated at a pressure\nthat produces a hoop stress of less than 20 percent of SMYS by performing an\nacceptable test weld, for the process to be used, under the test set forth in section I\nof Appendix C of this part. Each welder who is to make a welded service line\nconnection to a main must also first perform an acceptable test weld under section\nII of Appendix C of this part as a requirement of the qualifying test.\nTransCanada's welder qualification procedure shown on Drawing Number 61-E-W-4\ndoes reference those sections of API 1104 that provide guidance for welder qualification.\nInstead this procedure references CFR 49 Part 192 Appendix A for the current edition of\nAPI 1104.\n49 CFR 192 can not be used as a reference for procedures required by 49 CFR 192.\nInstead an operator's procedure must provide reference to the applicable industry\nstandard that has been incorporated by reference into 49 CFR 192.\n$192. 479 Atmospheric corrosion control; General.\n(a) Each operator must clean and coat each pipeline or portion of pipeline that is\nexposed to the atmosphere, except pipelines under paragraph (c) of this section.\n(b) Coating material must be suitable for the prevention of atmospheric corrosion.\n(c) Except portions of pipelines in offshore splash zones or soil-to-air interfaces, the\noperator need not protect from atmospheric corrosion any pipeline for which the\noperator demonstrates by test, investigation, or experience appropriate to the\nenvironment of the pipeline that corrosion will—\n(1) Only be a light surface oxide; or\n(2) Not affect the safe operation of the pipeline before the next scheduled\ninspection.\n\n\n\nTransCanada's procedure CC-31, Operation and Maintenance Instruction Sheet,\nInspections of Aboveground Gas Piping Atmospheric Corrosion does not specifically\nrequire coating at the air to soil interface if the coating is found deficient This\nprocedure only states that remedial actions will be taken if corrosion found.\n49 CFR 192. 479(c) requires that TransCanada have a procedure that requires coating\nsuitable to prevent corrosion of soil to air interfaces regardless if corrosion is not\nevident.\n$192. 745 Valve maintenance: Transmission lines.\n(a) Each transmission line valve that might be required during any emergency\nmust be inspected and partially operated at intervals not exceeding 15 months, but\nat least once each calendar year.\nTransCanada Operating Procedures (TOP) for Valve and Valve Operator M24\nInspection and Valve and Valve Operator M24 Leak Inspection/Cycle Test only requires\nthis testing and inspection occur at an interval not to exceed 15 months.\nAn operator's procedure must provide guidance for testing and inspection of valves once\neach calendar year. Additionally an operator must also provide guidance that in addition\nto the testing inspection once each calendar year, the period of time between these\ninspections cannot exceed 15 months.\nRes onse to this Notice\nThis Notice is provided pursuant to 49 U. S. C. ) 60108(a) and 49 C. F. R. ) 190. 237. Enclosed as\npart of this Notice is a document entitled Response Options for Pipehne Operators in\nCompliance Proceedings, Please refer to this document and note the response options. Be\nadvised that all material you submit in response to this enforcement action is subject to being\nmade publicly available. If you believe that any portion of your responsive material qualifies\nfor confidential treatment under 5 U, S. C. 552(b), along with the complete original document\nyou must provide a second copy of the document with the portions you believe qualify for\nconfidential treatment redacted and an explanation of why you beheve the redacted information\nqualifies for confidential treatment under 5 U S. C 552(b) If you do not respond withm 30 days\nof receipt of this Notice, this constitutes a waiver of your right to contest the allegations in this\nNotice and authorizes the Associate Administrator for Pipeline Safety to find facts as alleged in\nthis Notice without further notice to you and to issue a Final Order.\nIf, after opportunity for a hearing, your plans or procedures are found inadequate as alleged in\nthis Notice, you may be ordered to amend your plans or procedures to correct the inadequacies\n(49 C. F. R ) 190. 237). If you are not contesting this Notice, we propose that you submit your\namended procedures to my office within 30 days of receipt of this Notice. This period may be\nextended by written request for good cause.
