Box 35236\nSarasota, FL 34232-9701\nCPF 5-2008-5023M\nDear Mr Rose:\nFrom March 3-7, 2008, a representative of the Pipehne and Hazardous Materials Safety\nAdministration (PHMSA), pursuant to Chapter 601 of 49 United States Code, inspected your\npipehne facilities and records in Boise, Idaho\nAs a result of the inspection, it appears that you have committed a probable violation of the\nPipehne Safety Regulations, Title 49, Code of Federal Regulations. The item inspected and the\nprobable violation is:\n(a) Each operator shaH maintain current maps and records of its pipeline systems\nthat include at least the foHowing information;\n(1) Location and identification of the following pipeline facilities;\n(i) Breakout tanks;\n(ii) pump stations;\n(iii) Scraper and sphere facilities;\n(iv) Pipeline valves;\n(v) Facilities to which $195. 402(c)(9) applies;\n(vi) Rights-of-way; and\n(vii) Safety devices to which $195. 428 applies.\n(2) AH crossings of public roads, railroads, rivers, buried utilities, and foreign\npip elines.\n(3) The maximum operating pressure of each pipeline.\n(4) The diameter, grade, type and nominal wall thickness of aH pipe.\n\n\n\n(b) Each operator shall maintain for at least 3 years daily operating records that\nindicate-\n(1) The discharge pressure at each pump station; and\n(2) Any emergency or abnormal operation to which the procedures under $195. 402\napply*\n(c) Each operator shall maintain the following records for the periods specified;\n(1) The date, location, and description of each repair made to pipe shall be\nmaintained for the useful life of the pipe.\n(2) The date, location, and description of each repair made to parts of the pipeline\nother than pipe shall be maintained for at least 1 year.\n(3) A record of each inspection and test required by this subpart shall be maintained\nfor at least 2 years or until the next inspection or test is performed, whichever is\nlonger.\nThe Idaho Pipehne Corporation (IPC) did not have records pertaming to Part 195 402(a),\n(c)(4) (12-13), (e)(1), and (e)(7) durmg the inspection.\nUnder 49 United States Code, $ 60122, you are subject to a civil penalty not to exceed $100, 000\nfor each violation for each day the violation persists up to a maximum of $1, 000, 000 for any\nrelated series of violations. We have reviewed the circumstances and supportmg documents\ninvolved in this case, and have decided not to conduct additional enforcement action or penalty\nassessment proceedings at this time.
