The item inspected and\nthe probable violation is:\n1. §192.465 External corrosion control: Monitoring.\n(d) Each operator shall take prompt remedial action to correct any deficiencies\nindicated by the monitoring.\nRecords of the 2008 Annual Pipe-to-Soil Survey that was conducted by a contractor on behalf\nof the City of Coalinga, Department of Public Works, shows that of the 157 test stations tested,\n50 were below the mandatory minimum requirement of -0.850 mvdc; of these 50 readings, 10\nwere below -0.500 mvdc; and, six (6) were below -0.300 mvdc. However, the City of\nCoalinga did not take timely remedial actions to investigate and correct any deficiencies of\ntheir Cathodic Protection (CP) program. Therefore, the City of Coalinga failed to take prompt\nremedial action as required by §192.465.\n\n\n\nUnder 49 United States Code, § 60122, you are subject to a civil penalty not to exceed\n$100,000 for each violation for each day the violation persists up to a maximum of $1,000,000\nfor any related series of violations. We have reviewed the circumstances and supporting\ndocuments involved in this case, and have decided not to conduct additional enforcement\naction or penalty assessment proceedings at this time. We advise you to correct the item(s)\nidentified in this letter. Failure to do so will result in the City of Coalinga being subject to\nadditional enforcement action.\nNo reply to this letter is required. If you choose to reply, in your correspondence please refer\nto CPF 5-2009-0023W. Be advised that all material you submit in response to this\nenforcement action is subject to being made publicly available.
