Glendale Ave, Level 4\nGlendale, CA 91206\nRe: CPF 5-2010-0009\nWithdraw Case\nDear Mr. Lins:\nOn August 14, 2008, a representative from the Pipeline and Hazardous Materials Safety\nAdministration (PHMSA), pursuant to Chapter 601 of 49 United States Code, conducted\nan on-site pipeline safety inspection of Scholl Canyon Landfill Gas, Limited Partnership's\nlandfill gas operation in Glendale, California. As a result of the inspection, on March 2,\n2010, we issued Scholl a Notice of Probable Violation and Proposed Compliance Order,\nalleging that it did not have the required written plans, procedures, and programs to\noperate the 5.5-mile long transmission pipeline. In addition, Scholl did not have a written\nanti-drug or alcohol program and it appeared that Scholl had not tested employees or\ncontractors for drugs as required by Part 199 of the pipeline safety regulations.\nScholl responded on March 19, 2010, asserting that the line was a distribution line, not a\ntransmission line, and confirming that effective January 1, 2010, it was no longer the\nowner or operator of this pipeline. Scholl stated that the City of Glendale Water and\nPower was the new owner and operator.\nAs you are aware, since March 2010, PHMSA has been working with the City of\nGlendale to ensure that the landfill gas line is in compliance with the pipeline safety\nregulations. My staff conducted an additional inspection in November 2011, confirming\nthat the City of Glendale has made excellent progress toward compliance with the\npipeline safety regulations. The City has hired and trained appropriate personnel and\nestablished operations and maintenance procedures as well as implementing a drug and\nalcohol program.\n\n\n\nSince the City of Glendale was not a party to the enforcement proceedings issued under\nCPF 5-2010-0009 and Scholl is no longer the operator, PHMSA is withdrawing the\nNotice of Probable Violation. This case is now closed.
