Cummings\nAssistant Director\nCity of Redding\nRedding Electric Utility Gas Pipeline\n17120 Clear Creek Road\nRedding, CA 96001\nCPF 5-2011-0004W\nDear Mr. Cummings:\nOn March 16, 2010, a representative of the Pipeline and Hazardous Materials Safety\nAdministration (PHMSA) pursuant to Chapter 601 of 49 United States Code inspected manuals,\nrecords, and conducted a field audit of your pipeline facilities in Redding, California.\nAs a result of the inspection, it appears that the City of Redding has committed a probable\nviolation of the Pipeline Safety Regulations, Title 49, Code of Federal Regulations. The item\ninspected and the probable violation is:\n\n\n\n1. §192.605 Procedural manual for operations, maintenance, and emergencies.\n(b) Maintenance, and normal operations.\n(1) Operating, maintaining, and repairing the pipeline in accordance with\neach of the requirements of this subpart and Subpart M of this part.\nRedding Electric Utility Gas Pipeline receives gas from Pacific Gas & Electric (PG&E) at a\ndelivery station in Redding, California. At this location PG&E provides pressure control for the\npipeline. However, the City of Redding does not have any records from PG&E regarding the\nrequired annual inspection of over pressure devices in accordance with 49 CFR, Part 192,\nSubpart M, §192.739(a).\nUnder 49 United States Code, § 60122, you are subject to a civil penalty not to exceed $100,000\nfor each violation for each day the violation persists up to a maximum of $1,000,000 for any\nrelated series of violations. We have reviewed the circumstances and supporting documents\ninvolved in this case, and have decided not to conduct additional enforcement action or penalty\nassessment proceedings at this time. We advise you to correct the item(s) identified in this letter.\nFailure to do so will result in Redding Electric Gas Pipeline being subject to additional\nenforcement action.\nNo reply to this letter is required. If you choose to reply, in your correspondence please refer to\nCPF 5-2011-0004W. Be advised that all material you submit in response to this enforcement\naction is subject to being made publicly available.
