Box 196606\nAnchorage, Alaska 99519\nCPF 5-2011-0014W\nDear Mr. Joynor:\nOn June 1-2, 2011, a representative of the Pipeline and Hazardous Materials Safety\nAdministration (PHMSA), pursuant to Chapter 601 of 49 United States Code, inspected your\nPublic Awareness Program in Anchorage, Alaska.\nAs a result of the inspection, it appears that Alyeska Pipeline Service Company (Alyeska) has\ncommitted probable violations of the Pipeline Safety Regulations, Title 49, Code of Federal\nRegulations. The items inspected and the probable violations are:\n1. §192.616 (b) Public awareness\n(b) The operator's program must follow the general program recommendations of\nAPI RP 1162 and assess the unique attributes and characteristics of the operator's\npipeline and facilities.\nAlyeska did not consider or address the unique attributes and characteristics of their pipeline\nfacility. Specifically, Alyeska’s Public Awareness Program (PAP) does not address Alyeska’s\n149 mile Natural Gas Pipeline.\n2. §195.440 Public awareness\n(f) The program and the media used must be as comprehensive as necessary to\nreach all areas in which the operator transports hazardous liquid or carbon dioxide.\nA) Alyeska did not send out information targeting affected public or excavators before 2011, but\nrelied on newspapers and magazine ads for public awareness. Alyeska‘s PAP must meet\n§195.44 (f) and API 1162 section 2.8.\n\n\n\nB) Alyeska did not conduct an evaluation to determine the effectiveness of their program.\nAlyeska‘s PAP must meet §195.440 (f), API 1162 section 8.4 and Appendix E.\nC) Alyeska did not track the number of individuals or entities reached within each intended\nstakeholder audience group. Alyeska‘s PAP must meet §195.440 (f), and API 1162 section\n8.4.1.\nD) Alyeska did not determine the percentage of stakeholders reached. Alyeska‘s PAP must meet\n§195.440 (f), API 1162 section 8.4.2 and Appendix E.\nE) Alyeska did not conduct a survey to determine if their intended message was understood.\nAlyeska‘s PAP must meet §195.440 (f), API 1162 section 8.4.3 and Appendix E.\nF) Alyeska has not determined if stakeholders have learned or changed intended behaviors.\nAlyeska‘s PAP must meet §195.440 (f), API 1162 section 8.4.4 and Appendix E.\nUnder 49 United States Code, § 60122, you are subject to a civil penalty not to exceed $100,000\nfor each violation for each day the violation persists up to a maximum of $1,000,000 for any\nrelated series of violations. We have reviewed the circumstances and supporting documents\ninvolved in this case, and have decided not to conduct additional enforcement action or penalty\nassessment proceedings at this time. We advise you to correct the items identified in this letter.\nFailure to do so will result in Alyeska Pipeline Service Pipelines Company being subject to\nadditional enforcement action.\nNo reply to this letter is required.
