The item inspected and the\nprobable violation is:\n1. §192.9 What requirements apply to gathering lines?\n…\n(d) Type B lines. An operator of a Type B regulated onshore gathering line must\ncomply with the following requirements:\n(1) If a line is new, replaced, relocated, or otherwise changed, the design,\ninstallation, construction, initial inspection, and initial testing must be in\naccordance with the requirements of this part applicable to transmission lines.\n\n\n\nThere were no records available at the time of the inspection concerning the design, installation,\nconstruction, initial inspection, and initial testing of the approximately 4500’ of parallel 4”\nplastic gathering lines from the Hellman property to a point near Seal Beach Boulevard and\nAnchor Way. The Hellman Properties manager provided a set of drawings for review at the time\nof the field inspection, and stated that all records from the replacement project had been provided\nto the operator of the pipeline. Following the inspection, a reasonable amount of time was\nallowed for the records to be located, but no further pertinent material has been supplied.\nNote: You are required to thoroughly document your program and compliance with respect to\nthe Pipeline Safety Regulations, and records need to be made available for inspection.\nUnder 49 United States Code, § 60122, you are subject to a civil penalty not to exceed $100,000\nfor each violation for each day the violation persists up to a maximum of $1,000,000 for any\nrelated series of violations. We have reviewed the circumstances and supporting documents\ninvolved in this case, and have decided not to conduct additional enforcement action or penalty\nassessment proceedings at this time. We advise you to correct the item identified in this letter.\nFailure to do so will result in the Seal Beach Processing Joint Venture being subject to additional\nenforcement action.\nNo reply to this letter is required. If you choose to reply, in your correspondence please refer to\nCPF 5-2011-0015W. Be advised that all material you submit in response to this enforcement\naction is subject to being made publicly available.
