Poplar St.\nCasper, WY 82602\nCPF 5-2014-5018W\nDear Mr. True:\nDuring the week of August 20-24, 2012, a representative of the Pipeline and Hazardous\nMaterials Safety Administration (PHMSA), pursuant to Chapter 601 of 49 United States\nCode, inspected your Sussex Diesel Line in the Baker, Montana area.\nAs a result of the inspection, it appears that you have committed a probable violation of the\nPipeline Safety Regulations, Title 49, Code of Federal Regulations. The item inspected and\nthe probable violation is:\n1. §195.402 Procedural manual for operations, maintenance, and emergencies..\n(a) General. Each operator shall prepare and follow for each pipeline system a\nmanual of written procedures for conducting normal operations and\nmaintenance activities and handling abnormal operations and emergencies.\nThis manual shall be reviewed at intervals not exceeding 15 months, but at least\nonce each calendar year, and appropriate changes made as necessary to insure\nthat the manual is effective. This manual shall be prepared before initial\noperations of a pipeline system commence, and appropriate parts shall be kept\nat locations where operations and maintenance activities are conducted.\n\n\n\nThe operator raised the Davis block valve from a below grade location to an above ground\nlocation earlier in 2012. In doing this, it exposed part of the pipeline’s coating, external pipe\nsurface, and internal pipe surface. At the time of the inspection, there were no Exposed Pipe\nReports (PL-502) were available to document the condition of the pipeline. The operator’s\nprocedure requires completion of the Exposed Pipe Report PL-502 when the pipe is exposed\nand the operator did not follow this procedure as required by §195.402(a).\nUnder 49 United States Code, § 60122, you are subject to a civil penalty not to exceed\n$200,000 per violation per day the violation persists up to a maximum of $2,000,000 for a\nrelated series of violations. For violations occurring prior to January 4, 2012, the maximum\npenalty may not exceed $100,000 per violation per day, with a maximum penalty not to\nexceed $1,000,000 for a related series of violations. We have reviewed the circumstances\nand supporting documents involved in this case, and have decided not to conduct additional\nenforcement action or penalty assessment proceedings at this time. We advise you to correct\nthe items identified in this letter. Failure to do so will result in Belle Fourche Pipeline Co.\nbeing subject to additional enforcement action.\nNo reply to this letter is required. If you choose to reply, in your correspondence please refer\nto CPF 5-2014-5018W. Be advised that all material you submit in response to this\nenforcement action is subject to being made publicly available.
