As a\nresult of the inspection, Hilcorp Alaska was issued a Notice of Amendment on November 3,\n2015, which proposed amendment of procedures.\nHilcorp Alaska submitted its amended procedures on December 4, 2015. My staff has\nreviewed the amended procedures, and it appears that the inadequacies outlined in this Notice\nof Amendment have been corrected.\nThis letter is to inform you no further action is necessary and this case is now closed. Wilkins\nSenior Vice President of Alaska\nHilcorp Alaska, LLC\n3800 Centerpoint Dr., Suite 1400\nAnchorage, Alaska 99503\nCPF 5-2015-0016M\nDear Mr. Wilkins:\nOn March 23, 2015, a representative of the Pipeline and Hazardous Materials Safety\nAdministration (PHMSA), pursuant to Chapter 601 of 49 United States Code, inspected Hilcorp’s\nOperations and Maintenance manual, Department Of Transportation (DOT) Operator\nQualifications program, records, Control Room Management program and Beluga pipeline\nspecific Operations Manual for the pipeline from Kaloa Junction facility near Granite Point to\nBeluga.\nOn the basis of the inspection, PHMSA identified an apparent inadequacy within Hilcorp’s plans\nor procedures, as described below:\n1. §192. 615 Emergency plans.\n(b) Each operator shall: (1) Furnish its supervisors who are responsible for\nemergency action a copy of that portion of the latest edition of the emergency\nprocedures established under paragraph (a) of this section as necessary for\ncompliance with those procedures.\n(2) Train the appropriate operating personnel to assure that they are knowledgeable\nof the emergency procedures and verify that the training is effective.\n(3) Review employee activities to determine whether the procedures were effectively\nfollowed in each emergency.\nHilcorp did not establish adequate written procedures for verifying the effectiveness of its\nemergency plan training for operating personnel. Hilcorp procedures did not ensure that their\noperating personnel are knowledgeable of their emergency procedures.\n\n\n\nResponse to this Notice\nThis Notice is provided pursuant to 49 U.S.C. § 60108(a) and 49 C.F.R. § 190.237. Enclosed\nas part of this Notice is a document entitled Response Options for Pipeline Operators in\nCompliance Proceedings. Please refer to this document and note the response options. Be\nadvised that all material you submit in response to this enforcement action is subject to being\nmade publicly available. If you believe that any portion of your responsive material qualifies for\nconfidential treatment under 5 U.S.C. 552(b), along with the complete original document\nyou must provide a second copy of the document with the portions you believe qualify for\nconfidential treatment redacted and an explanation of why you believe the redacted information\nqualifies for confidential treatment under 5 U.S.C. 552(b). If you do not respond within 30 days\nof receipt of this Notice, this constitutes a waiver of your right to contest the allegations in this\nNotice and authorizes the Associate Administrator for Pipeline Safety to find facts as alleged in\nthis Notice without further notice to you and to issue a Final Order.\nIf, after opportunity for a hearing, your plans or procedures are found inadequate as alleged in this\nNotice, you may be ordered to amend your plans or procedures to correct the inadequacies (49\nC.F.R. § 190.237). If you are not contesting this Notice, we propose that you submit your\namended procedures to my office within 30 days of receipt of this Notice. This period may be\nextended by written request for good cause. Once the inadequacies identified herein have been\naddressed in your amended procedures, this enforcement action will be closed.\nIt is requested (not mandated) that Hilcorp maintain documentation of the safety improvement\ncosts associated with fulfilling this Notice of Amendment (preparation/revision of plans,\nprocedures) and submit the total to Chris Hoidal, Director, Western Region, Pipeline and\nHazardous Materials Safety Administration.
