The item\ninspected and the probable violation is:\n1. §195.64 National Registry of Pipeline and LNG Operators.\n(c) Changes. Each operator must notify PHMSA electronically through the\nNational Registry of Pipeline and LNG Operators at\nhttp://opsweb.phmsa.dot.gov, of certain events.\n(1) An operator must notify PHMSA of any of the following events not later than\n60 days before the event occurs:\n(ii) Construction of 10 or more miles of a new or replacement hazardous liquid\nor carbon dioxide pipeline.\n\n\n\nDuring the visit, it became evident that Discovery DJ Pipeline LLC owns and operates\nDiscovery 12-inch Winchester Pipeline, and has started construction of the proposed 17.42-\nmile pipeline. PHMSA was notified of an OPID request on July 24, 2017. Construction\nnotification was made on August 26, 2017. The weld logs indicated a start date of July 27,\n2017.\nUnder 49 U.S.C. § 60122 and 49 CFR § 190.223, you are subject to a civil penalty not to\nexceed $209,002 per violation per day the violation persists up to a maximum of $2,090,022\nfor a related series of violations. We have reviewed the circumstances and supporting\ndocuments involved in this case, and have decided not to conduct additional enforcement\naction or penalty assessment proceedings at this time. We advise you to correct the item\nidentified in this letter. Failure to do so will result in Discovery DJ Pipeline LLC being\nsubject to additional enforcement action.\nNo reply to this letter is required. If you choose to reply, in your correspondence please refer\nto CPF 5-2017-6032W. Be advised that all material you submit in response to this\nenforcement action is subject to being made publicly available.
