The Notice proposed finding that Respondent had violated the pipeline safety\nregulations in 49 C.F.R. Part 192 and proposed certain measures to correct the violations.\nRespondent did not contest the allegations of violation or corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 192.616(b) (Item 1) ─ Respondent failed to follow the general\nprogram recommendations of API RP 1162 and assess the unique attributes and\ncharacteristics of the operator’s pipeline and facilities in its public awareness\nprogram.\n49 C.F.R. § 192.805(b) (Item 2) ─ Respondent failed to have and follow a written\nqualification program that included provisions to ensure through evaluation that\nindividuals performing covered tasks are qualified.\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent.\n1 The Notice of Probable Violation incorrectly listed the CPF No. as 5-2020-051-NOPV. That error has been\ncorrected here. In the future, this matter should be referenced as CPF No. 5-2021-051-NOPV.\n\n\n\nCPF No. 5-2021-051-NOPV\nPage 2\nThe Director has indicated that Respondent completed the actions proposed in the Notice to\ncorrect the violations.
