The Notice proposed finding that Respondent had violated a\npipeline safety regulation in 49 C.F.R. Part 195 and proposed certain measures to correct the\nviolation. Respondent did not contest the allegation of violation or corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulation listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 195.402(a) (Item 1) ─ Respondent failed follow a manual of written\nprocedures for conducting normal operations and maintenance activities and\nhandling abnormal operations and emergencies in two instances.\nThis finding of violation will be considered a prior offense in any subsequent enforcement action\ntaken against Respondent.\nThe Director has indicated that Respondent completed the actions proposed in the Notice to\ncorrect the violation. Therefore, it is not necessary to include the proposed compliance terms in\nthis Final Order.\nThe terms and conditions of this order are effective upon service in accordance with 49 C.F.R.\n§ 190.5.\nAugust 17, 2022\n___________________________________ _________________________\nAlan K.
