The Notice proposed finding that Respondent had violated the pipeline\nsafety regulations in 49 C.F.R. Part 195. The Notice also proposed certain measures to correct\nthe violations. Respondent did not contest the allegations of violation or corrective measures.\nBased upon a review of all of the evidence, pursuant to § 190.213, I find Respondent violated the\npipeline safety regulations listed below, as more fully described in the enclosed Notice, which is\nincorporated by reference:\n49 C.F.R. § 195.402(a) (Item 1) ─ Respondent failed to follow its written\nprocedures when conducting normal operations and maintenance activities;\n49 C.F.R. § 195.583(a) (Item 2) ─ Respondent failed to inspect its pipeline that is\nexposed to the atmosphere for evidence of atmospheric corrosion; and\n49 C.F.R. § 195.581(a) (Item 3) ─ Respondent failed to provide protection\nagainst atmospheric corrosion.\nThese findings of violation will be considered prior offenses in any subsequent enforcement\naction taken against Respondent.\nCompliance Actions\nPursuant to 49 U.S.C. § 60118(b) and 49 C.F.R. § 190.217, Respondent is ordered to take the\nactions proposed in the enclosed Notice to correct the violations. The Director may grant an\nextension of time to comply with any of the required items upon a written request timely\nsubmitted by the Respondent and demonstrating good cause for an extension. Upon completion\n\n\n\nof the ordered actions, Respondent may request that the Director close the case. This Order\nincluded a Compliance Order. On August 29, 2024, PHMSA received P66’s response to the\nFinal Order. Based on our review of the documentation you provided, it has been determined\nthat you have complied with the terms of this Order.\nRegarding Items 1 and 2, the Compliance Order required Phillips 66 to follow its procedure to\ninspect each portion of pipe exposed to the atmosphere for evidence of atmospheric corrosion,\ndocument the findings, and remediate any deficiencies. According to the records submitted, P66\nhas amended its procedures and facility locations associated with this PHMSA inspection were\nre-inspected for evidence of atmospheric corrosion and deficiencies have been remediated.\nAccordingly, Items 1 and 2 have been completed.\nRegarding Item 3, the Compliance Order required P66 to clean and coat each unprotected portion\nof pipeline. According to the records submitted, P66 has cleaned and recoated pipeline facilities\nrequiring remediation. Accordingly, Item 3 has been completed.\nThis letter is to inform you no further action is necessary, this case is now closed.
