This includes an applicant seeking to renew an expired EX approval for the specific purpose of continuing the manufacturing of the firework device.\n\n          Issued Date: Friday, March 1, 2013\n\n<<<PAGE 1>>>\n\nMarch 2013\nSAFETY GUIDANCE\nGuidance on EX Classification\nApprovals with Expiration Dates\nThe Pipeline and Hazardous Materials Safety Administration\n(PHMSA), an agency of the U.S. Department of Transportation\n(DOT), is issuing guidance regarding PHMSA’s policy on EX\nClassification Approvals with expiration dates, as it applies to the\nmanufacturing and the transportation of the firework devices.\nThe Federal Register Notice, Clarification of the Fireworks\nApprovals Policy, 76 FR 38053 (June 29, 2011) states after\nJune 29, 2011, PHMSA will only accept fireworks approval\napplications from fireworks manufacturers or their U.S. designated\nagent on their behalf. This includes an applicant seeking to renew\nan expired EX approval for the specific purpose of continuing the\nmanufacturing of the firework device.\nOn January 5, 2012, PHMSA published a Federal Register\nNotice, Clarification and Further Guidance on the Fireworks\nApprovals Policy, 77 FR 429 (January 5, 2012), which addresses\nPHMSA’s implementation of its policy for EX Classification\nApprovals with expiration dates, noting that all firework approvals\nwith expiration dates will expire by the end of 2015. If an EX\nApproval has expired and is not renewed, the approval will no\nlonger be valid for manufacture of new items.
