This\nguide is intended only to provide information to the public regarding existing requirements under the Hazardous\nMaterials Regulations.\nBACKGROUND\nFor safety reasons, lithium batteries must be subjected\nto a series of design tests per sub-section 38.3 of the\nUnited Nations (UN) Manual of Tests and Criteria.\nDownstream shippers and consumers, however, often\ncannot confirm whether their battery was successfully\ntested. To address this issue, the Hazardous Materials\nRegulations (HMR; Parts 171-180) were amended to\nrequire manufacturers and distributors of lithium cells\nor batteries, except for button cells installed in\nequipment (including circuit boards), to make\navailable lithium battery test summaries (TS) using\na standardized set of elements specified in the UN\nManual of Tests and Criteria, Part III, Subsection 38.3,\nParagraph 38.3.5.\nEACH MANUFACTURER AND\nSUBSEQUENT DISTRIBUTOR OF\nLITHIUM CELLS OR BATTERIES,\nEXCEPT BUTTON CELLS\nINSTALLED IN EQUIPMENT\n(INCLUDING CIRCUIT BOARDS),\nMANUFACTURED ON OR\nAFTER JANUARY 1, 2008\nMUST MAKE AVAILABLE A TEST\nSUMMARY. SEE § 173.185(a)(3).\nThe Pipeline and Hazardous Materials Safety\nAdministration (PHMSA) developed this compliance\nassistance tool to assist manufacturers and distributors\nwith understanding and implementing the TS\nrequirement. PHMSA adopted this requirement as\npart of its HM-215O international harmonization\nrulemaking, effective January 1, 2022. The TS\nrequirement applies to lithium cells or batteries\nmanufactured on or after January 1, 2008.* HM-215Q\nupdated the requirement to except button cells installed\nin equipment, effective May 10, 2024.\n*This is a global requirement for domestic and international\ntransportation. In fact, for lithium cells and batteries offered for\ntransportation in accordance with the ICAO Technical Instructions\nfor the Safe Transport of Dangerous Goods by Air (ICAO\nTI) or the International Maritime Dangerous Goods Code (IMDG\nCode), the TS requirement was effective January 1, 2020.\n2\n\n<<<PAGE 3>>>\n\nWHAT INFORMATION MUST BE INCLUDED IN THE LITHIUM BATTERY TEST SUMMARY?\nLITHIUM CELL/BATTERY TS IN ACCORDANCE WITH SUB-SECTION 38.3 OF MANUAL OF\nTESTS AND CRITERIA\nThe following information shall be provided in the TS:\nA. Name of cell, battery, or product manufacturer, as applicable;\nB. C. Cell, battery, or product manufacturer’s contact information to include address, telephone number,\ne-mail address, and website for more information;\nName of the test laboratory to include address, telephone number, e-mail address, and website for\nmore information;\nD. A unique test report identification number;\nE. Date of test report;\nF. Description of cell or battery to include at a minimum:\ni. Lithium ion or lithium metal cell or battery;\nii. Mass of cell or battery;\niii. Watt-hour rating, or lithium content;\niv. Physical description of the cell/battery; and\nv. Cell or battery model number or, alternatively, if the test summary is established for a product con-\ntaining a cell or battery, the product model number;\nG. List of tests conducted and results (i.e., pass/fail);\nH. Reference to assembled battery testing requirements, if applicable (i.e., 38.3.3 (f) and 38.3.3 (g));\nI. Reference to the revised edition of the Manual of Tests and Criteria used and to amendments thereto, if\nany; and\nJ. (See 49 CFR 173.185 (a)(3))\nName and title of a responsible person as an indication of the validity of information provided.\nPHMSA | PIPELINE AND HAZARDOUS MATERIALS SAFETY ADMINISTRATION\n3\n\n<<<PAGE 4>>>\n\nLithium battery test summaries can be made available in a variety of ways, including via a product information sheet (like\nthe example below) and/or via a website. There is no set form or format for a lithium battery TS, but it must include all the\nrequired elements.\nTest Summary Example\nUN 38.3 Lithium Battery Test Summary\nCell, Battery or Product Model Number\nItem Number:\nItem Name:\nCell, battery, or product manufacturer’s contact information\nName:\nAddress:\nCity:\nState:\nZIP:\nCountry:\nTelephone:\nE-mail:\nWebsite:\nTest Laboratory\nName:\nAddress:\nCity:\nState:\nZIP:\nCountry:\nTelephone:\nE-mail:\nWebsite:\nCell or Battery Description\nCell or Battery:\nPhysical Description (dimensions, appearance):\nCell or Battery Type:\nWatt-hour rating or Lithium Content:\nCompleted Cell or Battery Weight:\nUnique Test Report ID Number:\nDate of test report:\nList of Tests Completed:\nYes Pass\nNo Fail\nAdditional Comments (or indicate compliance with other standards, e.g.,\nUnderwriters Laboratory):\nTest T.1: Altitude simulation\nTest T.2: Thermal test\nTest T.3: Vibration\nReference to assembled battery testing requirements, if applicable (i.e., 38.3.3 (f)\nand 38.3.3 (g)).\nTest T.4: Shock\nTest T.5: External short circuit\nTest T.6: Impact/Crush\nReference to the revised edition of the Manual of Tests and Criteria used and to\namendments thereto, if any:\nTest T.7: Overcharge\nTest T.8: Forced discharge\nName and title of a responsible person as an indication of the validity of information provided.\n4\n\n<<<PAGE 5>>>\n\nQUESTIONS/ANSWERS RELATED TO THE LITHIUM\nBATTERY TS:\nQ1: A1: Does the TS requirement apply to stand-alone cells or batteries as well as cells or batteries contained\nwithin products?\nThe TS requirement applies to cell and batteries contained in a product, except for button cells\ninstalled in equipment (including circuit boards).\nQ2: A2: I manufacture a product powered by lithium batteries. Must I produce a TS?\nYou would have to make available information about the lithium battery contained in your product,\nas required under § 173.185(a)(3) of the HMR. You can obtain information about the lithium batteries\ncontained in your product from your supplier.\nQ3: A3: I distribute a product that contains batteries produced from more than one manufacturer. May I\ninclude multiple batteries/manufacturers/products on one report?\nYes, it is acceptable to have a single document that covers multiple batteries/manufacturers/\nproducts, provided all required information is included.\nQ4: A4: Is it acceptable to list the various test laboratories, tests, and range of revisions tested to for the UN\n38.3 revision and amendments?\nYes, it is acceptable to have multiple test laboratories and products provided all required information\nis included. The test laboratory is not required to be aligned with a specific battery or product on the\nTS when the TS covers multiple batteries/products. It is required to have the test report number and\ndate of test for each cell/battery/product listed on the TS.\nQ5: A5: What is meant by \"physical description\" of cell/battery/product?\nA physical description is intended to provide information on the general characteristics of the\nbattery including shape, size, and the intended product application. Pictures or product sketches are\nespecially helpful here. For example: a cylindrical cell measuring 180 mm in length and 65 mm in\ndiameter or a lithium pouch battery permanently installed in a cellular telephone. Alternatively, the\ndescription could be the invoice description or marketing name of the product.\nQ6: When must the TS be made available?\nA6: The TS should be made available to an individual or entity in the supply chain upon request.\nPHMSA | PIPELINE AND HAZARDOUS MATERIALS SAFETY ADMINISTRATION\n5\n\n<<<PAGE 6>>>\n\nQ7: Do test summaries expire?\nA7: No, new or revised lithium battery test summary information would be required only if the cell\nbattery/device is of a different design that necessitated re-testing. In that instance, a new lithium\nbattery test summary would need to be generated.\nQ8: A8: Must a manufacturer or distributor include the TS with product shipments?\nNo, the TS does not need to be included with shipments, the product manufacturer or distributor only\nhas to make the information available. This may be achieved by placing this information on a website\nor through alternative means.\nQ9: A9: Would a general statement on a safety data sheet, website, email, or other document provided by the\nmanufacturer that the lithium batteries meet the test criteria satisfy the requirements of § 173.185(a)\n(3)?\nAlthough a shipper could rely on information provided by the battery or product manufacturer as\nevidence that the cell or battery meets the required tests, this would not meet the requirement for a\nmanufacturer or distributor to make available a lithium battery test summary as required by\n§ 173.185(a)(3).\nQ10: What is the model number and how can I find it?\nA10: The model number is a unique identifier that links a battery or product to a TS.\n- If the TS is for a product containing batteries, the model number(s) would be found on the product.\n- If the TS is for stand-alone batteries/stand-alone cells, the model number would be found on the\nbatteries/cells.\nQ11: A11: If a manufacturer considers their suppliers, test laboratory, and battery data confidential and\ncompetitive information, how would TS compliance be achieved?\nAll 10 data elements and listed subsets of information must be on the TS.
