Two\nseparate incidents occurred two days\nearlier at nearby residences served by\nthe same gas distribution system,\nresulting in second-degree burns to an\noccupant and causing significant\nstructural damage to the residences.1\nThe operator did not provide an\nimmediate notification to the National\nResponse Center (NRC) of either\nincident as required by 49 CFR 191.5 or\nfile a written incident report with\nPHMSA,2 asserting there was no\nevidence at the time that a release of\nnatural gas from its distribution system\nwas involved.3\nNTSB conducted an investigation and\ndetermined that the probable cause of\nthe February 23, 2018 incident was:\n. . . the ignition of an accumulation of\nnatural gas that leaked from the gas main\nthat was damaged during a sewer\nreplacement project 23 years earlier and was\nundetected by [the gas distribution\noperator’s] investigation of two related\nnatural gas incidents on the 2 days before the\nexplosion. Contributing to the explosion was\n[the gas distribution operator’s] insufficient\nwet weather leak investigation procedures.\nContributing to the severity of the explosion\nwas [the gas distribution operator’s] inaction\nto isolate the affected main and evacuate the\nhouses. Contributing to the degradation of\nthe pipeline system was [the gas distribution\noperator’s] inadequate integrity management\nprogram.4\nNTSB also issued Safety\nRecommendation P—21–1 to PHMSA,\nadvising the Agency to ‘‘[e]xpand\nincident reporting requirements in [49\nCFR] Part 191 so that events that may\nmeet the definition of ‘incident’ are\nimmediately reported to [NRC,] even\nwhen the source of the natural gas has\nnot been determined.’’ 5 NTSB’s\nAccident Report also lists industry\nguidance factors that pipeline operators\ncan use to determine whether an event\ncould be a reportable incident, such as\na rupture or explosion, fire, loss of\nservice, evacuation of people in the\narea, involvement of local emergency\nresponse personnel, and degree of\nmedia involvement (ANSI/GPTC 2018).6\nPHMSA’s regulations in 49 CFR part\n191 require operators of gas pipelines,\nUNGS facilities, and LNG facilities to\nnotify the NRC of an incident at the\nearliest practicable moment following\ndiscovery, but no later than one hour\nafter confirmed discovery.7 An\n‘‘incident’’ is defined in § 191.3 as any\nof the following events:\n(1.) An event that involves a release\nof gas from a pipeline, gas from a UNGS\nfacility, liquefied natural gas, liquefied\npetroleum gas, refrigerant gas, or gas\nfrom an LNG facility, and that results in\none or more of the following\nconsequences:\n(i) A death, or personal injury\nnecessitating in-patient hospitalization;\n(ii) Estimated property damage of\n[$149,700] or more, including loss to the\noperator or others, or both, but\nexcluding the cost of gas lost,8 [or]\n(iii) Unintentional estimated gas loss\nof three million cubic feet or more.\n(2.) An event that results in an\nemergency shutdown of an LNG facility\nor a UNGS facility.9\n(3.) An event that is significant in the\njudgment of the operator, even though it\ndid not meet the criteria of paragraph (1)\nor (2) of this definition.\nFor purposes of the incident reporting\nrequirements, ‘‘confirmed discovery’’ of\nan event occurs ‘‘when it can be\nreasonably determined, based on\ninformation available to the operator at\nthe time a reportable event has\noccurred, even if only based on a\npreliminary evaluation.’’ 10\nOperators are required to file\nadditional telephonic or electronic\nreports to NRC to confirm or revise the\ninitial estimates of the number of\nfatalities or injuries, amount of product\nreleased, or extent of damages.11 This\nmay include filing an updated NRC\nreport for a previously reported event\nthat an operator subsequently\ndetermines did not meet the regulatory\nreporting thresholds.\nPHMSA’s incident reporting\nrequirements play a critical role in\nensuring public safety. Federal, state,\nand local agencies need to be aware of\nincidents ‘‘at the earliest practicable\nmoment so that emergency personnel or\ninvestigators can be dispatched quickly\nto mitigate the consequences of such an\nevent.’’ 12 Incident reporting also\nprovides PHMSA and states with a\nmeans to identify safety issues,\nimplement preventative measures to\nmitigate safety risks, analyze trends, and\nenhance pipeline safety across the\nNation.\nPHMSA and its predecessor agency,\nthe Research and Special Programs\nAdministration, have issued numerous\nalerts and advisory bulletins\nemphasizing the importance of\ncomplying with the incident reporting\nrequirements in Part 191, and providing\ncomplete and accurate information\nduring emergencies.13 PHMSA\ncontinues to remind operators of gas\npipelines, UNGS facilities, and LNG\nfacilities of the requirement to report\nincidents to NRC at the earliest\npracticable moment following\ndiscovery, but no later than one hour\nafter confirmed discovery.\nGuidance and advisory bulletins are\nnot rules; are not meant to bind the\npublic in any way; and do not assign\nduties, create legally enforceable rights,\nor impose new obligations that are not\notherwise contained in regulations.\nI. For purposes of the incident\nreporting requirements in Part 191,\nconfirmed discovery occurs ‘‘when it\ncan be reasonably determined, based on\ninformation available to the operator at\nthe time a reportable event has\noccurred, even if only based on a\npreliminary evaluation.’’ 14\nPHMSA’s incident reporting\nregulations are intended to ensure that\nFederal, state, and local agencies are\nalerted to incidents ‘‘at the earliest\npracticable moment so that emergency\npersonnel or investigators can be\ndispatched quickly to [help] mitigate the\nconsequence of such an event.’’ 15\nOperators are reminded that the\nregulations require reporting of events\nthat are significant in the judgement of\nthe operators even if they do not meet\ncriteria specified in the regulations.16\nOperators are also reminded that the\nregulations require immediate\nnotification to the NRC of potential\nincidents based on available\ninformation, even if only a preliminary\nevaluation has been conducted.17 Gas\npipeline operators should also note that\nthe ‘‘[e]stimated property damage of\n$[149,700] or more’’ requirement under\n§ 191.3 does not include cost of gas lost\nbut does encompass certain ancillary\ncosts associated with the natural gas\nrelease event.\nPHMSA notes that NTSB’s Accident\nReport identifies factors that pipeline\noperators can use to determine whether\nan incident might be reportable.
