Proper classification and the\nassignment of a packing group for a hazardous material (hazmat)\nplays a key role in the selection of an appropriate packaging for\nhazmat.\nRequirements\nThe physical and chemical properties of unrefined petroleum-based\nproducts are complex and can vary by region, time of year, and\nmethod of extraction. In accordance with §173.41, shippers in all\nmodes of transportation must develop and carry out a sampling\nand testing program for all unrefined petroleum-based products by:\n•\nSufficiently testing and documenting the physical and chemical\ncharacteristics of hazmat to ensure proper classification;\n•\nCertifying that the sampling and testing program is in place, and\nensuring this information is available to DOT personnel upon\nrequest; and\n•\nProperly classing and describing unrefined petroleum-based\nproducts offered for transportation as prescribed in §173.22\n(shippers’ responsibility).\nA person may offer hazmat for transportation in a packaging or\ncontainer required by §173.22 if that person:\n•\nClasses and describes the hazmat in accordance with parts 172\nand 173 of the subchapter, and\n•\nDetermines that the packaging or container is an authorized\npackaging including part 173 requirements.\n\n<<<PAGE 3>>>\n\nComponents of the Sampling and Testing Plan\nThe shipper must properly classify unrefined petroleum-based\nproducts based on the following minimum requirements:\n•\nFrequency—\n– History,\n–\n– Temperature,\n–\n– Method of extraction (including chemical use),\n–\n– Location of extraction,\n–\n– Time of year, and\n–\n– Length of time between shipments.\n–\n•\nSampling prior to the initial offering for transportation and\nwhen changes that may affect the properties of the material\noccur (i.e., mixing of the material from multiple sources);\n•\nSampling methods that ensure a representative sample of the\nentire mixture;\n•\nTesting methods that enable classification of the material;\n•\nQuality control of measure sample frequencies;\n•\nDuplicate sampling methods for quality assurance;\n•\nCriteria for modifying the sampling; and\n•\nTesting or other methods used to identify properties of the\nmixture relevant to packaging requirements.\nCertification\nWhen certifying a shipment, the shipper is stating that the\nrequirements in §173.41 have been met. The shipper must enter\nthe certification on the shipping paper and sign either manually,\nby typewriter, or by other mechanical means. An acceptable\ncertification (see §172.204) is as follows:\nThis is to certify that the above-named materials are properly\nclassified, described, packaged, marked, and labeled, and are in\nproper condition for transportation according to the applicable\nregulations of the U.S. Department of Transportation.\n________________\n_______\nShipper’s signature Date\n\n<<<PAGE 4>>>\n\nDocumentation\nPersons required to develop and implement a sampling and testing\nprogram must:\n•\nMaintain a copy of the sampling and testing program\ndocumentation in writing;\n•\nRetain documentation as long as the program is in effect\n(minimum of one year);\n•\nRevise or update as necessary;\n•\nReview annually;\n•\nMake the most recent version (changes) available to employees\nresponsible for implementing the plan; and\n•\nMake documentation available, upon request, to authorized\nofficial(s).\nResponsibility\nHAZMAT\nAs stated in §173.1(b), shipments of hazmat not prepared\nfor shipment in accordance with this subchapter may not be\ntransported by air, rail, highway, or water.\nIt is the responsibility of the hazmat employer to ensure that each\nhazmat employee is trained in accordance with the requirements of\nthis subchapter.\nIt is the responsibility of the offeror to instruct each of his officers,\nagents, and employees—having any responsibility for preparing\nhazmat for shipment—on the applicable HMR requirements.\nFailure to comply with these regulations may result in civil penalty\nactions.
