Howard Avenue\nDes Plaines,\nIL 60018\nDear Mr. Graska:\nThis is in response to your letter dated March 27, 2000 and\nregarding the applicability of the Hazardous Materials\nsubsequent telephone conversation with a member of my staff\nRegulations (HMR; 49 CFR Parts 171-180) to movements of hazardous\nmaterials on private roads.\nSpecifically, you ask if the\nmovement of hazardous materials on a restricted road between\nhangar and terminal locations at Chicago O'Hare International\nAirport is subject to the HMR.\nBased on the information you provided, the answer is no. The HMR\ngovern the safe transportation of hazardous materials in\nintrastate, interstate, and foreign commerce. Transportation of\nhazardous materials exclusively on private property, to which\nsigns, gates and guard stations prevent public access, is not\nsubject to the HMR.\nI hope this satisfies your request.\nSincerely,\nJohn A.
