Box 4267\nSpringfield, MO\n65808-4267\nDear Mr. McGowen:\nThis is in response to your letter dated March 22, 2000, and\nsubsequent telephone conversation with a member of my staff\nconcerning the applicability of the hażardous materials\nregistration program under Part 107, Subpart G, of the\nHazardous Materials Regulations (HMR; 49 CFR Parts 171-180).\nSpecifically you ask if your company must register if the only\nhazardous materials your company transports are marine\nbatteries and propane cylinders.\nOn February 14, 2000, RSPA promulgated, Docket HM-208C (65 FR\n7297), which expanded the criteria for persons required to\nregister under Part 107, Subpart G. Effective July 1, 2000,\nin addition to the existing requirements under § 107.601, any\nperson who offers or transports in commerce a quantity of a\nhazardous material that requires placarding under Part 172,\nSubpart F, must register.\nThis additional provision does not\napply to those\nactivities of a farmer that are in direct\nsupport of one's farming operations.\nTherefore, provided your company does not transport more than\n1,001 pounds (aggregate gross weight) of batteries or propane\ncylinders, you do not have to register.\nWe hope this satisfies your request.\nSincerely,\nTransportation Regulations Specialist\nOffice of Hazardous Materials Standards\n17322\n000110\n\n<<<PAGE 2>>>\n\n....\nFax (417) 866-5166\nTransportation, inc.\nP. On occasion there will be shipments involving\ncommodities such as Coleman gas cylinders (filled) as in the kind and type that screw into a\nlantern. There will also be Marine batteries, both sealed and fillable.\nIt is our understanding that we do not have to have a Federal Hazmat License to participate in the\nmovement of the above, so long as when handling this material the driver has a current haz mat\nendorsement on his license, that he has been trained within the last three years on hazardous\nmaterial handling, and should the volume/weight of any of these hazardous commodities exceed\n1,000 Ibs, that the shipper provide the appropriate placards.\nPlease respond to the following and thank you for your assistance!\nSincerely,\nDirector of Safety\nMember American Trucklng Association - Truckload Carrier Conference","truncated":false,"body_characters":3267}
