You inquire\nof air carrier company materials (COMAT) under the Hazardous\nwhether an air carrier, who has elected not to carry hazardous\nmaterials, may transport items of replacement that are subject to\nthe HMR on their passenger carrying aircraft.\nPart 175 of the HMR applies to the acceptance, loading, and\ntransportation of hazardous materials in any aircraft in the\nUnited States and in\naircraft of U.S. registry anywhere in air\nSection 175.10 (a) (2) of the HMR contains certain\nlimited exceptions for hazardous materials required in accordance\nwith applicable airworthiness requirements\nand operating\nlimited exceptions to the packaging requirements of the HMR for\nregulations under 14 CFR.\nIn addition, this section contains\nCOMAT items of replacement (spares)\nfor these hazardous\nmaterials.\nAn air carrier who transports COMAT is subject to the\npackage quantity and compartment limitations, discrepancy and\ntraining, marking, labeling, shipping paper and certification,\nincident reporting, and notification of pilot-in-command\nrequirements of the HMR. See enclosed advisory guidance Notice\nNo. 96-25\n(61 FR 65479; December 13,1996) and other informational\nmaterials.\nUnder the Federal Aviation Regulations, an air carrier that\ntransports COMAT must have an FAA approved hazardous materials\n(dangerous goods) program or it must offer the COMAT to another\ncarrier authorized to transport hazardous materials.
