No. 00-0282\nInceptor, Inc.\n1301 Progress Avenue\nToledo, Ohio 43612\nDear Mr. Watkins:\nThis responds to your October 3, 2000 letter requesting clarification on the exception in\n§ 173.150(e) of the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180).\nSpecifically, you ask whether the three aqueous solutions of alcohol specified in your letter\nare eligible for the exception in § 173.150(e).\nAccording to § 173.150(e), aqueous solutions of alcohol containing 24% or less alcohol by volume\nand no other hazardous materials may: (1) be reclassed as a combustible liquid; and (2) is not subject\nto the requirements of the HMR if it contains no less than 50% water. According to your letter, all\nthree aqueous solutions of alcohol contain less than 24% alcohol by volume, no other hazardous\nmaterials, and also contain more than 50% water. Based on the information provided in your letter, it\nis the opinion of this Office that the three aqueous solutions of alcohol described in your letter are not\nsubject to the requirements of the HMR.\nI hope this answers your inquiry.\nSincerely,\nPen tillo\nDelmer F.
