No. 00-0312\nAlkaloids Corporation\n8 Bentinck Street\nCalcutta-700 001\nDear Mr. Karnani:\nThis responds to your request for assistance in determining the\nUnited Nations identification number for \"capsicum oleoresin.\"\nIt is your understanding that because of the material's\ncharacteristics, it may be considered dangerous cargo in\ntransportation.\nYour letter provides no information about the physical state\nproperties of your particular product or the manner in which the\n(solid, liquid, aerosol), chemical composition or hazard\nmaterial is packaged.\nTherefore, we are unable to provide you\nwith\nany specific guidance.\nUnder § 173.22 of the U.S. Hazardous\nMaterials Regulations (HMR; 49 CFR Parts 171-180), it is the\nshipper's responsibility to properly classify a material in\naccordance with the hazard class definitions in Part 173. If the\nmaterial does not meet a hazard class definition and, in\naddition, does not meet the definition of a hazardous substance,\nhazardous waste, or a marine pollutant as defined in § 171.8, the\nmaterial would not be regulated as a hazardous material under the\nHMR.\nDepending upon its properties and form when offered for\ntransportation, capsicum oleoresin may be a Class 9 material, an\naerosol if pressured with a gas, it may meet some other hazard\nclass or may not be regulated.\nThe material's manufacturer is\nthe best source for this information.\nI assume your intent is to export the material to the United\nStates.\nIf the material is a hazardous material under the HMR\nand if all or part of the transportation is by vessel,\n§ 171.12 (b) of the HMR permits, with certain exceptions, a\nplacarded and described in accordance with the requirements of\nhazardous material that is classed, packaged, marked, labeled,\nthe International Maritime Dangerous Goods Code to be offered and\naccepted for transportation in the United States.\nSee 49 CFR\n171.12.
