Specifically, you\ninquire whether\na shrink-wrap and cardboard combination would\nsatisfy the requirement of a strong outer packaging for a\nphotographs showing your client's current fiberboard box\nConsumer commodity, ORM-D, under § 173.156. You enclosed\npackaging and a proposed, half-box packaging (tray) that is\ntriple shrink-wrapped to a pallet.\nYou state that your client's product, an alkyd resin primer of\nmedium viscosity with a closed-cup flash point of 70°F and an\ninitial boiling point of 240°-375°F, is assigned to Packing Group\nII.\nSee S 173.121(a). The primer\nis contained in one gallon\nmetal cans.\nThe use of shrink-wrapped trays as an outer packaging for\nconsumer commodities is authorized in S$ 173.25 and 173.156.\nHowever, a flammable liquid, that is also a consumer commodity,\nmust first meet the limited quantity provisions specified in\n$ 173.150 (b)to be eligible for re-classification.\ngallon cans\nexceed this quantity nearly four-fold. A viscous\nliquid in Packing Group II may, however, be reassigned to Packing\nGroup III provided it conforms to the conditions specified in\n§ 173.121 (b). The one gallon cans of primer would then be\neligible for re-classification as an ORM-D and may be renamed\n\"Consumer commodity.\"\nIf your client's primer does not meet the viscosity criteria in\n§ 173.121 (b), it must be packaged either in a UN standard meeting\n173,25\n0C0333\n\n<<<PAGE 2>>>\n\nthe Packing Group II performance level packaging as specified in\nS173.202,\nor in strong outer packaging conforming to subpart B\nof Part 173 as specified in § 173.173 (b) (2).\nI trust this satisfies your inquiry.\nPlease contact us if\nwe\ncan\nbe of\nfurther assistance.\nSincerely,\nHalli z.
