No. 00-0340\nDirector, Quality Assurance\nSeatex Corporation\n6325 Hurst Street\nHouston, '\nTX\n77008\nDear Mr. Trepel:\nThis is in response to your December 5, 2000, letter requesting\nclarification of shipping paper and placarding requirements under\nthe Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180).\nSpecifically, you ask if shipping papers and placards are\nrequired when empty non-bulk packages, which contain the residue\nof a hazardous material, are transported via a contract carrier\nto a drum reconditioner.\nGenerally, empty packagings containing a residue of a hazardous\nmaterial must be transported in the same manner as when they\npreviously held a greater quantity of the material, unless the\npackagings are sufficiently cleaned and purged of vapors to\nSEATE\nremove any potential hazard, or are refilled with a material\ncontaining only the residue of a hazardous material covered by\nTable 2 of § 172.504 collected and transported by a contract or\nprivate carrier for reconditioning, remanufacture or reuse is\nexcepted from the shipping paper requirements in Part 172,\nSubpart C.\nTherefore, if the shipment is made by a private or\ncontract carrier, it is not subject to the shipping paper\nrequirements ($ 173.29 (c) (2)).\nIn addition, a non-bulk packaging\ncontaining only the\nresidue of a hazardous material covered by\nTable 2 of § 172.504 is not subject to the placarding\nrequirements in Part 172, Subpart F\n(§ 173.29 (c) (1)) .\nI hope this satisfies your request.\nSincerely,\nTransportation Regulations Specialist\nOffice of Hazardous Materials Standards\n173,29\n000340\n\n<<<PAGE 2>>>\n\nBAH\neatex\nOORPORATION\n§173.29(6)(2)\nIpplicabilit\nResiduk\nDecember 5, 2000\n00-0340\nMr. Edward Mazzullo\nDirector, Office of Hazardous Materials Standards\nUS DOT / RSPA (DHM10)\n400 Seventh Street SW\nWashington D.C. 20590-0001\nDear Mr. Mazzullo:\nWe will be contracting with a company to collect and transport our empty non-bulk\npackages to a drum reconditioner.
