Specifically, you ask if the HMR\napply to the DOD when it is transporting radioactive materials\nin DOD conveyances operated by DOD personnel.\nThe federal government is not subject to the HMR unless it\noffers for transportation or transports a hazardous material\nin commerce or in furtherance of a commercial enterprise.\nTransportation is not in furtherance of a commercial\nenterprise if it is carried out by governmental personal for a\ngovernmental purpose.\nTherefore, DOD is not subject to the\nrequirements of the HMR when it ships hazardous materials on\nvehicles which are operated by a government employee (military\nor civilian) provided the shipment does not further a\ncommercial\nenterprise. However, contractors are not\ngovernmental personnel.
