Such determinations are not\nrequired to be verified by this office. Under 49 CFR 173.22, it is the shipper's responsibility to\nproperly classify a hazardous material. Such determinations are not required to\nbe verified by this office.\nBased upon the test results you provided, it is our opinion that the ferrosilicon\nmanufactured by Silicon Technology (Pty) Ltd does not meet the criteria of a\nDivision 4.3 and provided it does not meet any other hazard class, it is not\nsubject to the HMR.\nI hope this satisfies your inquiry.
