Box 116\nWeyers Cave, VA 24486\nDear Mr. Paynter:\nconversation with a\nThis is in response to your letter and subsequent telephone\nmember of my staff asking whether your\nfumigation marking is in accordance with 49 CFR 173.9.\nThe answer is no.\nSection 173.9(c)states that except for the\nsize and color, the FUMIGANT marking must be as set forth in the\nillustration.\nThe text in your marking varies considerably from\nthe illustration and, therefore, does not meet the requirements\nof paragraph (c).\nAs provided in paragraph (b), if your FUMIGANT\nmarking is authorized by the Environmental Protection Agency\n(EPA) under 40 CFR, Part 156, it may be used\nthe 49 CFR FUMIGANT marking; however, as you stated on the\nas an alternative to\ntelephone, your marking has not yet been approved.\nI hope this information is helpful. Mazzullo\nDirector of OHMS\nU.S. DOT/RSPA (DHM-10)\n400 Seventh Street, S.W.\nWashington, DC 20590-0001\nRe: 49 CFR 173.9 - Fumigation Placarding\nDear Mr. Mazzullo:\nDegesch America, Inc. manufactures the restricted use\npesticide/fumigant, Phostoxin®. One of the primary uses of this EPA approvec\nproduct is to fumigate commodities loaded in transport vehicles or freight\ncontainers for domestic and international shipment.\nThe provisions of 49 CFR 173.9 requires a fumigation placard to be\nattixed to all fumigated transport vehicles/containers. The enclosed placard,\nDAI Form #11075, has been in use for many years and is considered an\nindustry standard. It has been brought to our attention that this placard may\nnot be acceptable under the provisions of 49 CFR 173.9. The text of our\nplacard is quite extensive when compared to that required in 49 CFR 173.9.\nUnder the labeling provisions of 40 CFR 156, the EPA requires very\nspecific text with regards to placarding fumigated areas. If you refer to the\nenclosed EPA approved applicator's manual, page 14, section 6, the specific\ninformation required by the EPA is identified.\nDegesch America, Inc. is requesting, under 49 CFR section 107.14(2)(b),\na written determination of acceptability of Degesch's fumigation placard, Form\n#11075, with regards to compliance with 49 CFR 173.9 provisions for\ninternational and domestic use.
