Box 1115\nwarrenton,\nOR 97146-1115\nDear Mr. Fulton:\nThis is in response your March 8, 2001 letter, regarding the\napplicability of the 24-hour emergency response phone number\nto Carbon dioxide, solid (Dry ice) under the Hazardous\nMaterials Regulations (HMR; 49 CFR Parts 171-180).\n'Section 172.604 requires offerors of hazardous materials to\ninclude on a shipping paper a 24-hour emergency response phone\nnumber for use in the event of an emergency involving the\nhazardous materiąl.\nHowever, certain hazardous materials are\nnot required\nto have an emergency response phone number\n($ 172.604 (c)). Do\nthe requirements of the section of the regulations (for a 24-hour emergency contact\nnumber) apply for Carbon dioxide, solid?\nIn CFR 49, 172.604 (c) it states, \"The requirements of this section do not apply to - (1)\nlimited quantities: and (2) Material properly described under the following shipping names:\nHazardous materials that are offered for transportation under the provision applicable to\nBattery powered equipment....Carbon dioxide, solid...... Dry ice..... Wheelchair, electric\"\nI have spoken to your staff via your office via telephone at 1-800-467-4922. I was informed\nthat shipments containing Carbon dioxide, solid, as a refrigerant, by water, do not require a\n24-hour emergency response telephone number to be listed. I understand the basis for this\ninterpretation is that the traditional use of \"and\" does not apply to link 172.604 (c) (1) and\n172.604 (c) (2) together.
