Specifically, you ask if a\ncombustible liquid that also meets the definition of a marine\npollutant is excepted from the HMR under § 173.150 (f) (2) when\ntransported by highway, rail, or aircraft in a non-bulk\npackaging.\nThe answer is yes. Section 173.150 (f) (2) specifies that the HMR\ndo not apply to a\ncombustible liquid in a non-bulk packaging\nunless the combustible liquid is a hazardous substance, a\nhazardous waste or a marine pollutant.
