Box 2463\nHouston,\nTX 77252\nDear Mr.\nMashinski:\nThis is in response to your August 1, 2001 letter requesting\nclarification of the shipping paper\nMaterial Regulations\nrequirements under the Hazardous\n(HMR; 49 CFR Parts 171-180) pertaining to the\nshipping description \"Residue: Last Contained, Flammable liquids,\nn.o.s., 3, UN1993, III, RQ (Ethylbenzene).\"\ninconvenience that the delay in responding may have caused you.\nI apologize for any\nSpecifically, you ask whether the letters \"RO\" must be removed from\nYou state that prior to the return trip, the tank car will be\nthe basic shipping description for the return trip, of a tank car.\nquantity of a hazardous\nunloaded and, therefore, will no longer contain the reportable\nsubstance.\nThe answer is no.\ndescription on the shipping paper for\nIn accordance with § 172.203 (e) (2), the\nresidue of\nLast Contained * * *\" before the basic description. Our question to Mr. Supko concerned the\ndescription on a shipping paper for a tank car containing the residue of a hazardous material\nwhich, when fully loaded, contained a reportable quantity of a hazardous substance but after\nunloading does not.\nFor example: a tank car containing a Class 3 material of which ethylbenzene is a component\nis described as follows when shipped from the manufacturing location:\n\"Flammable Liquids, NOS (XXXXX, Ethylbenzene), 3, UN1993, III, RQ (Ethylbenzene)\".\nAfter unloading, the residual product in the tank car contains much less than the 1000 pound\n1\nreportable quantity of ethylbenzene; however, the shipper's computer generated return Bill off.\nLading would contain the following description:\n\"Residue Last Contained: Flammable Liquids, NOS (XXXXX, Ethylbenzene), 3, UN1993,\nIII, RQ (Ethylbenzene)\".\nTechnically speaking, since the car no longer contains a reportable quantity of a hazardous\nsubstance, the person returning the residue tank car would be required to remove the \"RQ\n(ethylbenzene)\" from the description; however, having read the attached interpretation from\nRSPA dealing with the same topic for a Class 9 material, we are persuaded that the residue\ntank car in our example may be returned without modification of the description. Mr. Supko\nconcurred with our interpretation. We would appreciate your written confirmation of our\ninterpretation.\nOur thanks in advance for your prompt consideration of this request.
