Dear Mr. Bahia:
This is in response to your letter of October 17, 2001, inquiring about the conditions under
which the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180) permit bulk
packagings (cargo tank motor vehicles) manufactured and certified in accordance with the
Transportation of Dangerous Goods (TDG) Regulations issued by Transport Canada to be
used for transportation of hazardous materials into and through the United States.
For shipments which originate in Canada and either terminate in the U.S. or transit the U.S.
to a Canadian or foreign destination, when the HMR require a DOT specification cargo tank
motor vehicle to be used for a hazardous material, a cargo tank motor vehicle authorized by
the TDG regulations may be used only if it corresponds to the DOT specification authorized
in the HMR (see § 171.12a(b)(13)). A TC specification cargo tank motor vehicle may be
used to transport a material, such as a combustible liquid, n.o.s., that is not subject to the
specification packaging requirements of the HMR. The HMR in § 171.12a(a) authorize the
return to Canada of empty cargo tank motor vehicles containing residue of hazardous
materials which originally were imported into the U.S.
I trust this satisfies your inquiry.
incerely
