Inc.\nSafety Office\nRD #1 Box 270\nA\nEdinburg,\nPA 16116\nDear Mr. Snyder:\nThis responds to your letter regarding the requirements in\n§ 177.834 (g) to secure hazardous materials packages against\nmovement when transported by motor vehicle under the Hazardous\nMaterials Regulations\n(HMR; 49 CER Parts 171-180). You ask\nwhether packages of Fireworks, Division 1.3G, that are overpacked\nwould satisfy the prevention of motion requirements under\n$ 177.834 (g). In addition, you ask whether the overpack is\nrequired to\nbe secured within the motor vehicle.\nThe requirements in § 177.834 (a) and (g) are met when the\npackages of hazardous materials are secured in a manner that\nprecludes their movement within the transport vehicle, and\nbetween the packages themselves, under conditions normally\nincident to transportation. These conditions most often include\nvehicle starting, stopping, cornering, accident avoidance, and\nvaried road conditions.\nIf the packages are overpacked, the\nvehicle.\noverpack itself must also be secured within the transport\nSpecific methods for securing packages in a motor vehicle are not\ndefined in the HMR. However, general requirements which address\nprotection of shifting cargo\n'arrier Safety Regulations (49 CFR Parts 300-399), specificalli\nare found in the Federal Moto:\nmethods of securement, such as blocking with other freight,\nunder SS 393.100 to 393.106.
