Box 1098\nAshburn, Virginia 20146-1098\nDear Mr. Baird:\nThis responds to your March 7, 2002 letter requesting clarification of the definition for a\n\"chemical kit\" under the International Civil Aviation Organization's (ICAO) Technical\nInstructions and the Hazardous Materials Regulations (HMR; 49 CFR Parts 171-180).\nSpecifically, you ask if the definition of a \"Chemical Kit\"' in Special Provision A44 of the ICAO\nTechnical Instructions and Special Provision 15 of Part 172 of the HMR also apply to materials\nbeing shipped individually for replacement purposes.\nSpecial Provision A44 describes chemical kits as boxes, cases, etc., containing small amounts of\none or more compatible dangerous goods that are used for medical, analytical, or testing\npurposes. Special Provision 15 describes chemical kits as boxes, cases, etc:, containing śmall\namounts of various compatible dangerous goods which are used for medical, analytical, or\ntesting purposes and for which exceptions are provided in this subchapter. It is the opinion of\nthis Office that materials being shipped individually for replacement purposes may not be\ndescribed as chemical kits under these special provisions. Therefore, the replacement material\nmust be described using the appropriate basic description for the material being offered for\ntransportation.\nI hope this answers your inquiry.\nDelmer F.
