Dear Ms. Orth:
This responds to your March 8, 2002 letters requesting clarification on § 172.203 (a) under the
Hazardous Materials Regulations (FMR; 49 CFR Parts 171-180). Specifically, you ask if a generic
shipping description with a subsidiary hazard of Class 8 or Division 4.2 is required to have the
exemption number, e.g., DOT-E 11153, written in association with the basic description. In addition,
you ask if the exemption number, e.g., DOT-E 9723 and DOT-E 10441, is required to be written in
association with the basic shipping description.
These three exemptions provide no relief from the HMR other than as specifically stated in the
exemption. Therefore, the exemption number is required to be written on the shipping paper in
association with the basic shipping description in accordance with § 172.203(a).
