Specifically, you question whether individuals engaged in the manufacture\nof corrugated boxes and marking them with the ORM-D designation are considered hazardous\nmaterials employees and require training as specified in the Hazardous Materials Regulations (HMR; 49\nCFR Parts 171-180).\nIt is the opinion of this Office that the individuals as described are hazmat employees and require\nhazmat training because they perform covered functions; i.e., manufacturing packagings used for\nhazardous materials and apply markings on the package. As required in § 172.702(a)(b), a hazmat\nemployer shall ensure that each of its hazmat employees is trained in accordance with the requirements\nprescribed in this subpart.\nAs defined in § 171.8, a hazmat employee means a person who is employed by a hazmat employer and\nwho in the course of employment directly affects hazardous materials transportation safety. The term\nincludes an owner-operator of a motor vehicle which transports hazardous materials in commerce. This\nterm includes an individual, including a self-employed individual, employed by a hazmat employee who,\nduring the course of employment: loads, unloads, or handles hazardous materials; manufactures, tests,\nreconditions, repairs, modifies, marks, or otherwise represents containers, drums, or packagings as\nqualified for use in the transportation of hazardous materials; prepares hazardous materials for\n172.702\n020172\n\n<<<PAGE 2>>>\n\n•\ntransportation; is responsible for safety of transporting hazardous materials; or operates a vehicle used\nto transport hazardous materials. A hazmat employee who performs any function subject to the\nrequirements of this subchapter may not perform that function unless instructed in the requirements of\nthis subchapter that apply to that function.\nI hope this information is helpful.
