Brandes:\nThis is in response to your letter dated July 8, 2003 and\nsubsequent telephone conversation with a member of my staff,\nconcerning the regulation oi calcium carbide pursuant to the\nYour questions are paraphrased and answered as follows:\nHazardous Materials Regulations (HMR; 49 CFR Parts 171-180).\nQ1. Must calcium carbide (Division 4.3, UN1402, Packing Group\nWet\" placard?\nII), shipped as a limited quantity, 'display a-\"Dangerous When\nA1.\nDivision 4.3 solids in Packing Groups, Il and III are excepted\nNo...\nSection 173.151 (d) states that limited quantities of\nfrom labeling, unless offered for transportation or\ncontained in inner packagings not over 0.5kg (1.1 pound) net\nstate that Division 4.3 solids in Packing Group II must be\ncapacity each packed in strong outer packagings.\n02. If a shipment qualifies as a limited quantity per\nexceptions in 173.151(d), is it still a hazardous material?\nA2.\nYes.\n03. If a shipment qualifies as a limited quantity per\naircraft?\nexceptions in 173.151 (d),\ncan it be loaded on passenger\nA3. As shown in the Hazardous Materials Table (S 172.101),\ncalcium carbide in Packing Group II is not forbidden from\npackage is limited to 15 kg.\nbeing loaded on passenger aircraft, but the net quantity per\nSection 173.151 (d) states that\nlimited quantities of Division 4.3 solids in Packing Groups LI\nand III are excepted from labeling as long as it is not\noffered for transportation or transported by aircraft.\nThis\n173.151\n030179\n\n<<<PAGE 2>>>\n\nlanguage does not preclude the material from being loaded on\nis being offered for transportation or transported by air that\npassenger aircraft, but it does require that if the material\nit comply with the appropriate labeling requirements for\npackaging\nDivision\n4.3 Packing Group II materials.\nrequirements specified in 173.27 apply to shipment\nIn addition,\nby aircraft.\n04.
