No. 03-0189\n14000 Westfair East Drive\nHouston, TX 77041\nDear Ms. Tipton:\nThis is in response to your request for clarification of your\nunderstanding of the requirements\nunder the Hazardous Materials\nhazardous materials.\nRegulations (HMR; 49 CFR Parts 171-180) regarding mixtures of\nrelated questions: 1) Does a mixture of three hazardous\nSpecifically, you ask the following\ntwo of the constituents to be listed in parentheses following the\nconstituents (toluene, isopropanol and hexane) require at least\nhexane)\"; and 2) Does a product containing one hazardous\nproper shipping name (\"Flammable liquid, n.o.s.(toluene,\nwith a non-hazardous material require only the hazardous\ncomponent (listed in the Hazardous Materials Table (HMT)) mixed\nmust the non-hazardous material also be listed?\ncomponent in parentheses\nfollowing the proper shipping name, or\nYou are correct that for mixtures and solutions containing more\nthan one hazardous\ntechnical names of at least two components most predominately\nmaterial, § 172.203 (k) (1) requires the\ncontributing to the hazards of the mixture or solution to be\nlisted when the material is described by a proper shipping name\nidentified by the letter \"G\" in Column (1) of the HMT.\nTherefore, if toluene and hexane are the two components that most\npredominately contribute to the hazard of your mixture, the\nproper shipping name \"Flammable liquid, 1.o.s. (toluene, hexane)\"\nis correct.\nFor mixtures and solutions containing one hazardous component\nhazardous materials, the product must be described using the\nthat is listed in the HMT by technical name and one or more non-\nqualifying word\nproper shipping name of the hazardous component with the\n\"mixture\" OI \"solution, \" unless one of the\n172.10/\n030189\nFOCACAN\n\n<<<PAGE 2>>>\n\nconditions in s/172:101 (c) (10) (i) is met.\nconditions in paragraph (c) (10) (i) is met, the most appropriate\nwhen one of the\nhazardous component is required in parentheses following the\ngeneric or n.o.s. proper shipping name may be used and only the\nstated in your letter.\nI hope this information is helpful. We need your help in resolving the matter. It\nrelates to the following 49 CFR sections:\n\"A mixture or solution not identified in the Table. specifically by name, comprised of two or more hezardous\nRe: 172.101 (F) iii\ningredients in the same hazard class, shall be described using an appropriate shipping description (e.g.\nalcohol not listed by it's technical name in the Tabie shall be described as Aicohol, NOS rather than\nFlammable Liquid, NOS). The name that most appropriately describes the material shall be used, e.g. an\nFlammable Liquid, NOS. Some mixtures may be more appropriately described according to their\nprovisions of suparts C and D of this part, the technical names of at least two components most\napplication such as \"coating solution\" or \"Extracts flavoring liquid\" rather than by an nos entry. Toluene, Isopropanol and Hexane). My interpretation of the above sections is that at\nleast 2 of those ingredients must be listed In parentheses after the nos notation.
