Whittington\nPresident\nRef No. 04-0061\nGrammar Industries\n18375 East 345 South\nGrammar, IN 47236\nDear Mr. Whittington:\nThis responds to your February 20, 2004 email to Mr. Danny Shelton of the Federal Motor\nCarrier Safety Administration and subsequent telephone conversation with a member of my staff,\n(HMR; 49 CFR Parts 171-180) applicable to shipping papers. Your questions are paraphrased\nlenn t'oster, requesting clarification of the requirements in the Hazardous Materials Regulations\nand answered below.\nQ1.\nIs the person performing the function of an offerer responsible for providing the\ndescription of a hazardous material on the shipping paper as required by the HMR?\nA1.\nYes. As required in § 172.200, each person who offers a hazardous material for\ntransportation must describe the hazardous material on the shipping paper in the manner\nrequired by Subpart C of the HMR.\nQ2.\nIs the Shipper's Certification statement required on the shipping paper accompanying a\ncargo tank transporting hazardous waste?\nA2.\nYes. As required in § 172.204, each person who offers a hazardous material for\ntransportation shall certify that the material is offered for transportation in accordance\nwith Subchapter C of the HMR by printing on the shipping paper containing the required\nshipping description the certification contained in § 172.204(a)(1) or the certification\n(declaration) containing the language in § 172.204(a) (2).\nQ3.\nIs the Environmental Protection Agency (EPA) Form 8700-22, Uniform Hazardous\nWaste Manifest an appropriate shipping paper as required by the HMR?\nA3.\nYes. As defined in § 171.8, a shipping paper means a shipping order, bill of lading,\nmanifest, or other shipping document serving a similar purpose and containing the\ninformation required by §§ 172.202, 172.203 and 172.204 of the HMR. In addition, as\ncontaining all of the information required by Subpart C of the HMR, may be used as the\nprovided in § 172.205(h), a hazardous waste manifest required by 40 CFR part 262.\nshipping paper required by this subpart.\n040061\n$172.200\n\n<<<PAGE 2>>>\n\nQ4.\nDoes the Generator' Certification of the Uniform Hazardous Waste Manifest meet the\nshipper's certification requirements of the HMR?\nA4.\nThe Generator's Certification on a Uniform Hazardous Waste Manifest does not conform\nit is the opinion of this Office that the EPA's current Generator's Certification statement\nin all respects to the shipper certification statements required under the HMR. Please inform us if\nVickery's assumptions with respect to the responsibility for\nnot,\noux assumptions are correct; or, if\nwhy not and what regulations should we reference.\nThis request centers on 49 CFR 172.200, 172.204 (b) and 172.205.\nWith regard to 172.200 -- Grammer and Vickery assumes that, with respect\nto\nperson\nthe \"description of hazardous materials\" (on shipping papers), the\nperforming the function of \"offerer\" is responsible for compliance.\nWith regard to 172.204 (b)\\ -- Grammer and Vickery assumes that shippin\npapers\ndetermined and described on the shipping papers by the offerer), must\naccompanying a cargo tank, laden with a hazardous waste (a:\ncontain the \"shippers certification\" as mandated by 49 CFR 172.204 (a).\n\n<<<PAGE 4>>>\n\nWith regard to 172.205 - - Grammer and Vickery assumes the following:\n1. That the so-called \"Uniform Hazardous Waste Manifest\" (EPA\nregulations; and,\n8700-22) is an\nappropriate \"shipping paper\" as required by DOI\n8700-22) meets\nThe \"Generator's Certification\" (item #16 on EPA Form\nthe \"shippers\ncertification\" requirements at 172.204 (b), and,\nresponsibility\n3.\n40 CFR 262.20 (referenced within 172.205) places the\ndescription\nfor proper preparation of\nthe manifest (including commodity\nand certification) on the \"generator\" (acting in its\ntransportation) .\ncapacity as one who \"offers\" hazardous\nwaste for\nneed\nI have attached 3 specific movements that have caused concern.
