Box 702\nMilwaukee, WI 53201-0702\nDear Mr. Mourand:\nThis responds to your letter and our telephone conversation\nregarding the classification of your product under the\nHazardous Materials Regulations (49 CFR Parts 171-180).\nSpecifically, you ask what regulatory requirements apply to\nyour product, a fuel stabilizer that is both a combustible\nliquid with a flash point of 68 °C (155 °F) and a marine\npollutant.\nYour product is packaged in non-bulk packaging\nand is offered for transportation by motor vehicle, rail\ncar, and internationally by vessel. I apologize for the\ndelay in responding and any inconvenience it may have\ncaused.\nIn accordance with § 171.4 of the HMR, the requirements of\nthe HMR applicable to marine pollutants do not apply to a\nmarine pollutant in a non-bulk packaging transported by\nmotor vehicle, rail car, or aircraft.\nFurther, a material\nclassed as a combustible liquid in accordance with\n§ 173.150 of the HMR is excepted from the HMR when\ntransported by motor vehicle or rail car (see\n§ 173.150 (f) (2) and (f) (3)). Thus, for transportation by\nhighway or rail, a combustible liquid is not subject to the\nHMR when offered\neven if the combustible liquid also meets the definition\nor transported in a non-bulk packaging,\nfor a marine pollutant.\nIn accordance with § 173.120 (b) (2), for transportation by\nvessel, a liquid with\na flash point above 60.5 °C (141 °F)\nthat contains the marine pollutant di-tert-butylphenol\nwould be described as \"Environmentally hazardous\nUN3082, III, Marine Pollutant\" when offered for\nsubstances, liquid, n.o.s. (di-tert-butylphenol), Class 9,\ninternational transportation by vessel in a non-bulk\npackaging. Also note that § 171.12 authorizes use of the\n§191.4\n040074\n171.12\n\n<<<PAGE 2>>>\n\nInternational Maritime Dangerous Goods Code when\ntransporting the hazardous materials by vessel.\nI trust this satisfies your inquiry.
