No. 04-0286\nKenan Advantage Group, Inc\n4076 Seaport BLVD\nWest Sacramento, CA 95691\nDear Mr. Redmon:\nThis is in response to your letter dated December 14, 2004, requesting clarification of the\nHazardous Materials Regulations (HMR; 49 CFR Parts 171-180). Specifically, you ask how\nmuch gasoline or diesel fuel you may unintentionally release during the hookup and breakdown\nof loading and unloading hoses before being required to submit a Hazardous Materials Incident\nReport (§ 171.16).\nPursuant to § 171.16, each person in physical possession of a hazardous material must submit a\nwritten or electronic report, using DOT Form F 5800.1, within thirty days of the date of\ndiscovery of a reportable incident as defined in § 171.15(b) or when any of the conditions set\nforth in § 171.16(a)(1)-(4) is met. There are exceptions to release reporting in § 171.16(d)\nprovided the incident is not otherwise subject to immediate telephone notification. For example,\nthe incident reporting requirements do not apply to minimal amounts of hazardous materials (i.e.,\na pint or less) escaping: (1) from a vent for materials for which venting is authorized; (2) from\nthe routine operation of a seal, pump, compressor, or valve; or (3) from the connection or\ndisconnection of loading or unloading lines, provided the release does not result in property\ndamage (§ 171.16(d)(1)).\nI hope this satisfies your request.\nSincerely,\nChief, Standards Development\nOffice of Hazardous Materials Standards\n171.14\n040286\n\n<<<PAGE 2>>>\n\nBAH\n3171.16\n1 2.053\nIncident Reports\nDRINKCE\nGROUP INC.\n04-0286\nDecember 14, 2004\nMr. Edward T. The largest part of our business is serving the transportation and delivery\nneeds of major oil companies with regard to their service station requirements.\nOn average we deliver over 1350 truck and trailer loads daily, because of this volume, it\nis not uncommon that during hook up and breakdown of loading and unloading hoses\nthat a small quantity of petroleum products may hit the concrete pad.\nThis unintentional release is cleaned up immediately with industrial absorbents that are\nproperly disposed of upon the trucks return to our facilities.\nSince the EPA does not have a reportable quantity for gasoline and diesel fuel, we are\nrequesting your interpretation of a reportable quantity (i.e. more than a gallon or quart or\npint etc.) so that we can comply with the intent of the regulation.\nThank you for your cooperation.\nSincerely,\nBruce Redmon\nAssistant Director of Safety\n4895 Dressler Road • Canton, Ohio 44718 • 330-491-0474 • 330-419-1471 (fax) • www.thekag.com\n4076 Seaport Blvd • West Sacramento, California 95691 • 916-371-8241 • 916-372-1760 (fax) • www.thekag.com","truncated":false,"body_characters":3218}
