Specifically, you ask\nif this packaging should be treated\nas either a bulk or non-\nbulk package and how the package should be marked, labeled,\nand/or placarded.\nFor the purposes of marking, labeling, and placarding, a\nshipment of electric storage batteries secured to a pallet in\naccordance with § 173.159 (c) (1) is considered to be a single\nnon-bulk package.\nThe completed package must be marked in\naccordance with § 172.301 and labeled in accordance with\n§ 172.400. The palletized batteries should be marked and\nlabeled as a non-bulk package even if the completed package\nI hope this information is helpful. According to\nMr. Delmer Billings letter to Mr. Paul Martin of Advanced Environmental Technical\nServices, dated June 10, 1996 (attached), batteries shipped under the provisions of\n49 CFR 173.159 (c) (1) can be shipped as one package. However, there is no mention of\nwhether these batteries (shipped as one package) would be considered a bulk or non-bulk\npackage for marking, labeling and/or placarding.\nWould this package be a bulk or non-bulk package and how would that be determined\nbased on the \"bulk packaging\" definition in 49 CFR 171.8? Martin:\nThis is in response to your letter of April 16, 1996,\nrequesting clarification on the packaging requirements for\nbatteries under the Hazardous Materials Regulations\n(HMR; 49\nCFR parts 171-180).\nSpecifically you ask whether a\npalletized load of batteries shipped under the provisions of\n49 CFR 173.159 (c) (1) is considered to be one package or\nwhether each battery on the pallet would be considered a\nseparate package.\nSection 173.159 (c) (1) allows electric storage batteries that\nare protected against short circuits to be transported in a\nnon-specification packaging (e.g., firmly secured to skids or\npallets capable of withstanding the shocks normally incident\nto transportation and meeting certain other conditions).\nSuch a configuration is considered one package; each battery\nneed not be considered a package.\nExcept as discussed foI\nbatteries, you are correct in your understanding that\ngenerally when packages are shrinkwrapped to a pallet the\nshrinkwrap is an overpack.\nEach individual package in an\noverpack must be in full compliance with the HMR, including\nmarking and labeling.\nI hope this information is helpful.\nSincerely,\n7989\nf1\nmar Hillin\nDelmer F.
