Specifically, you ask if\nradioactive materials are excluded from the general requirements for packagings and\npackages in § 173.24(b)(1).\nThe answer is no. Each package used for the shipment of hazardous materials shall be\ndesigned, constructed, maintained, filled, its contents so limited, and closed, so that under\nconditions normally incident to transportation, there will be no identifiable (without the\nuse of instruments) release of hazardous materials to the environment (§ 173.24(b)(1)).\nThese general requirements for packagings and packages apply to all hazard classes,\nunless otherwise excepted.\nI hope this satisfies your request.\nSincerely,\nChief, Standards Developmen\nOffice of Hazardous Materials Standards\n173.24 650)\n050099\n\n<<<PAGE 2>>>\n\nPage 1 of 1\nWilliams, James <PHMSA›\nFrom: Jule Fausto jjfausto@utah.gov]\nBAH\nSent:\nTuesday, April 19, 2005 4:22 PM\n5173-24 b)(1)\nTo:\nWilliams, James <PHMSA>\nCc:\nBoyd Imai; John Hultquist\nPackagings +\nSubject: Regarding 173.24(b)(1)\nPackages\nHello James:\n05-0099\nI have a question regarding 173.24(b)(1) which states,\n\"there can be no identifiable release (without the use of\ninstruments) of hazmat to the environment\". Does this exclude radioactive materials since in many cases the\nonly way to identify if RAM material has escaped to the environment is with the use of instruments. For\ninstance, an incident involving I.SA wher liquid material leaked fro a rail car of solid material was determined to\nbe radioactive but this was determined only after taking measurements of what had leaked out of the rail car.\nThis was shipped as a lined gondola.\nI looked through the \"opinion\" letters on the PHMSA website but could not find any letters applicable. I would\ngreatly appreciate an intrepretation or any insight\nthat you could provide.\nThank you,\nJule Fausto\nTransportation Specialist\nState of Utah, DEQ, DRC\n4/21/2005","truncated":false,"body_characters":2356}
