No.: 05-0242\nLake Tomahawk, WI 54539\n6627 Northshore Drive\nDear Mr. Kettler:\nThis is in response to your September 26, 2005 letter and\nsubsequent telephone conversation regarding the applicability\nof the Hazardous Materials Regulations (HMR; 19 CFR Parts\nIn your detailed scenario, you have a 100-gallon\ntank for diesel fuel that is connected to your vehicle's (a\npick-up truck) fuel tank.\nYou want to mount an additional\n100-gallon tank for gasoline to fuel your boat and\nall-terrain vehicles.\nYou ask if you are subject to the\nrequirements of the HMR.\nThe answer is no.\nThe HMR govern the safe transportation of\nhazardous materials in commerce as specified in § 171.1. The\nphrase \"in commerce\" generally means in furtherance of a\ncommercial enterprise.\nA private citizen who transports\nhazardous materials for non-commercial purposes in a private\nvehicle is not subject to the HMR (See § 171.1 (d) (6); copy\nenclosed) .\nI hope this information is helpful.
