You provided a material safety data sheet for a material\nof similar composition to carbon black and you indicated that your product does not\ndisplay the characteristics of either a Division 4.1 or a Division 4.2 material.\nIn accordance with § 173.22, it is the shipper's responsibility to properly classify a\nhazardous material. Such determinations are not required to be verified by this office.\nYou did not provide sufficient information to enable us to make a determination\nregarding classification. However, if the material does not meet the definition of either\nDivision 4.1 or 4.2 or any other hazard class or division in the HMR, the material is not\nsubject to the HMR.\nI hope this information is helpful. Industry sources (MSDS) indicate Carbon black is not regulated in\ntransportation. NOSH references indicate that Carbon black is regulated (49 CFR 172) as Carbon,\nanimal or vegetable origin UN 1361, PG II or III, label code 4.2.\nOur product is mostly carbon (mineral origin), and D-E Black does not display the characteristics (readily\ncombustible, self-heating, spontaneous combustible) of a 4.1 or 4.2 material. Attached is a MSDS of D-\nE Black. Based on the information provided, is this product regulated in transportation for cornmerce? If\nso, what is the hazardous material description and proper shipping name?\nYour determination is greatly appreciated.
