Specifically, you ask if\na limited quantity Class 7 (Radioactive) material could also meet the definition of a Class\n9 (Miscellaneous) material in accordance with the HMR.\nThe answer is no. For the purposes of the HMR, a Class 9 material is defined as \"a\nmaterial which presents a hazard during transportation but which does not meet the\ndefinition of any other hazard class.\" See § 173.140. The material in question does not\nmeet the definition of a Class 9 material because it meets the definition of another hazard\nclass.\nI hope this information is helpful.\nSincerely,\nLoma tro\n(Chief, Standards Development\nOffice of Hazardous Materials Standards\n173.140\n060033\n\n<<<PAGE 2>>>\n\nSRS\nSAVANNAH RIVER SITE\nAiken, SC: 29808 • www.srs.gov\nEichenlaud\nFebruary 6, 2006\n$173.140\nOffice of Hazardous Materials Standards\nDefinition\nPipeline and Hazardous Materials Safety Administration\nAttn: PHH-10,\n06-0033\nU.S. Department Of Transportation\nWashington Sc\nDC 20590-0001\nLIMITED QUANTITY CLASS 7 INTERPRETATION REQUEST\nIt is the position of Washington Savannah River Company (WSRC) that Class 9 materials\ndescribed in 173.140 shall not meet the definition of any other hazard class and must not be\nrepresented as having a subsidiary hazard of any other hazard class.
